AA, p. 83-85 Court of Equity-Fall Term 1840-Registered: Nov. 4th, 1842. Petition of Isaac, John & Amos ROCHELLE, guardians of Jacob & Benjamin ROCHELLE in sale of land. State of North Carolina County of New Hanover Whereas at the Fall Term A.D. 1840 of the Court of Equity for the county of New Hanover aforesaid a decree was made in the matter there appearing? in said Court upon the petition of Isaac ROCHELLE, John ROCHELL and of Amos ROCHELL as the Guardian of Jacob ROCHELLE and Benjamin ROCHELL (praying for the sale of certain tracts or parcels of land described in said petition directing and empowering the Clerk and Master of said Court to make title in the purchasers of several tracts of land as set forth in this report of the Commission and confirmed by said court under certain conditions and restrictions set forth in said decree and whereas Jacob ROCHELL became the purchaser of the following described tracts or parcels of land as appears from the report of the Commissioners, that is to say a certain tract or parcel of land lying and being in the County of New Hanover aforesaid near Angola Swamp and Curry Comb Branch beginning at a pine by Acton? Marsh thence north 55o East 240 poles to the branch formerly belonging to DEBINSK?, thence North 35o West 200 poles to a pine, thence S 55o West 240 poles to a cypress, thence S 35 East 200 poles to the beginning containing by estimation 300 acres of land also one other tract or parcel of land in the County aforesaid near Angola Swamp and Curry Comb Branch beginning at the beginning corner of a Patent granted to Thomas RAMSEY near the head of little Dog Branch and runs as said patent South 60o West 134 poles to a pine thence South 36o East 56 poles to a stake. Thomas RAMSEY’S corner thence North 71o East 252 poles to a stake on the Patent line, then along the Patent line North 29o West 25 poles to the patent corner, then the open line about North 85 West 138 poles to the beginning containing by estimation one hundred acres of land, the tracts or parcels of land hereby intended to be described being the first and second of five tracts of land conveyed by Jacob JAMES to Benjamin ROCHELL by deed dated the 8th day of August 1818 and registered in the Records of New Hanover County in Book 2 page 223 and whereas the said Jacob ROCHELL has in all things completed with the requirements of said decree, now therefore this Indenture witnessth that I, William E. LORD, Clerk and Master in Equity for the County of New Hanover aforesaid by virtue of the power and authority aforesaid and of every power we hereunto enabling and in consideration of this sum of three hundred and one dollars (the purchase money of the tracts of land herein before described) paid by the aforesaid Jacob ROCHELL the receipt of which is hereby acknowledged have granted bargained sold and conveyed and to hereby grant bargain sell and convey unto the said Jacob ROCHELL his heirs and assigns the tracts or parcels of land herein before described, together with all and singular the profits privileges and appurtenances to the same belonging or in anywise appertaining. To have and to hold the same unto the said Jacob ROCHELLE his heirs and assigns to his and their only proper use benefit and behoof forever. And the aid William C. LORD for himself his heirs, executors and administrators also hereby covenant with the said Jacob ROCHELL his heirs and assigns that no act has been done by him by which the title hereby intended to be made can be in any manner changed changed or defeated and that he will warrant and defend the title to the before described tracts or parcels of land unto the said Jacob ROCHELL his heirs and assigns so far as he is bound to do by virtue of his Office of Clerk and Master in Equity for the County of New Hanover but no further.
