Z, p. 90-94 Courtesy of Jean Talbert State of North Carolina This Indenture mad and executed this the fourteenth day of March A.D. 1842 between Amos ROCHELLE of the county of New Hanover in the State of North Carolina of the first part and Isaac ROCHELLE of the same place of the second part. Witnesseth that where as the said Amos ROCHELLE is indebted to sundry personas, and is unable to pay and discharge all and singular the several debts by him owning and being delivered tot satisfy in full certain debts herein after more particularly referred to, and after the payment and satisfaction of said debts hereinafter set forth, that the residue of his property should be applied as hereinafter set forth to the satisfaction of his remaining creditors. This Indenture witnesseth that the said Amos ROCHELLE for and in consideration of the sum of one dollar to him in hand paid by the said Isaac ROCHELLE at and before the sealing and delivery of these presents, the receipt of which is hereby acknowledged hath given granted bargained sold assigned transfer and set our to the said Isaac ROCHELLE the following tracts or parcels of land situate lying and being int he County of New Hanover viz a tract of land containing ninety eight acres beginning at a forked cypress on the run of Dog Branch near the mouth of Gum Branch, Jacob JAMES corner and running thence along said JAMES line South 14? West one hundred & sixteen poles to a stake in said line, the South 36? East thirty poles to a pine, thence North 65? East one hundred and forty poles to a pine stump in a meadow, thence North 35? West one hundred and eighty four poles to a black gum on the run of Dog Branch, thence down the run of said branch to the beginning, being the same which was granted to said Amos ROCHELLE by Letters Patent Registered in the Records of New Hanover County in Book V page 18-Also another tract of land containing two hundred & fifty eight acres on the East Side of Dog Branch beginning at a gum on the run of said branch at Benjamin ROCHELLES corner, running North 82? East one hundred & forty six poles to a pine by the side of Gum Branch, then across a prong of said branch North 35? East ninety poles to a pine by the side of said branch, then North 42? East eighty poles to a pine the common corner of Jacob JAMES & John JAMES, then along Jacob JAMES'S line North 60? West one hundred & eighty poles to a stake by a small branch said Jacob JAMES'S corner, then with another line of said Jacob JAMES'S North 65? East thirty poles to a pine by Hog House Meadow Branch, thence North 3? East one hundred & eighty poles to a stake on the run of Dog Branch then down said branch to the beginning; being the tract of land granted to Jacob JAMES by Patent registered in the records of New Hanover County in Book W page 47-Also another tract of land containing two hundred & forty one acres, beginning at John BURTON'S corner, then South 70? West one hundred & fourteen poles to a pine, then North 12? West twenty six plus to a pine, then North 83? West one hundred and fifty poles to BURTON'S other corner then north eighty East one hundred & twenty eight plus then North 10? West ninety poles to a pine, then South 80? West one hundred & seventy eight poles, then north 60? West one hundred & eighty poles to Hog House Meadow Branch, then up said Branch North one hundred poles to a KENNAN? line, then South sixty five East three hundred & sixty five poles to S. BURTON'S line, thence such? to the beginning-being the tract of land Granted to Jacob JAMES as appears by Patent Registered in the Records of New Hanover County in Book O page 308, together with all & singular the profits privileges and appurtenances in any manner belonging to the before described tracts of land; and also all the estate right, title interest property claim & demand of the said Amos ROCHELLE of in & to the same & of in & to any part and parcel thereof. This Indenture further witnessed that the said Amos ROCHELLE for and in consideration of the promises & the further sum of One Dollar to him in hand paid by the said Isaac ROCHELLE the recipe of which is hereby acknowledged hat given granted assigned & set our hand by these present doth give grant assign and set outré the said Isaac ROCHELLE the following personal property now in this possession viz thirty head of cattle, thirty head of Hogs, one hundred barrels of hard turpentine, thirty five barrels of soft turpentine, one horse & cart, two beds and furniture. To have and to hold the before described tracts or parcels of land with the appurtenances thereto belonging and the personal property aforesaid unto the said Isaac ROCHELLE his heirs executors administrators and assigns, to his and their only proper use -- and behoof forever. In trust nevertheless and upon the express condition that the said Isaac ROCHELLE shall within a reasonable time, after having given twenty days notice at three or more public places in the County aforesaid expose to sale at public auction at such place as to him shall sum list upon such terms as he shall consider most beneficial to all concerned all & singular the before described seal and personal property and after having collected the money rising from said sale he shall apply and appropriate the same in manner following viz having first paid satisfied and discharged all such costs charges and expenses as ma have been incurred in the drafting & registration of these presents and all such costs charges and expenses as may have been incurred by the said Isaac ROCHELLE in the sale aforesaid and int he collection and disbursement as herein after set forth of the proceeds of said sale, he shall apply and appropriate the residue in following manner, viz to the payment and satisfaction of the claims and demands herein after particularly referred to in equal proportions, pro rate viz a note made by said Amos ROCHELLE and secured by Larkins LANIER payable to John ROCHELLE six months after its date of Oct. 1st, 1839 for about one hundred & thirty dollars a note made by said Amos ROCHELLE and secured by said Isaac ROCHELLE & John ROCHELLE payable on day after its date April 16th, 1840 to Jacob CANTEEN, Jr. for sixty five dollars-a note made by said Amos ROCHELLE and secured by John ROCHELLE payable to Jacob CANTEEN, Jr. six months after date of Oct 3rd 1839 for thirteen 50/100 dollars, a note made by said Amos ROCHELLE and secured by Snoden PEARCE payable to Abraham ANDREWS and now belonging to Riley DAVIS for fifty dollars due about Dec., 25th, 1841, a note made by Amos ROCHELLE aforesaid & secured by John ROCHELLE and Jacob ROCHELLE payable to Archibald BRANCH for thirty 50/100 dollars due about Dec. 25th 1841- not made by said Amos ROCHELLE and secured Jacob CANTEEN payable to Watson B. FOY, Oct 1st, 1841 for seventy five dollars, note for about thirteen dollars payable to Peter SMITH made by said Amos ROCHELLE & secured by John ROCHELLE due to payable Dec. 11th, 1839; and two hundred and seventy 17/100 dollars, the amount due by said Amos ROCHELLE as the guardian of Benjamin ROCHELLE as appears by the return made by said Amos ROCHELLE s the guardian as aforesaid to the December Term A. D. 1841 of the Court of Pleas & Quarter Sessions for the County of New Hanover, said payment to be made to such person as may be appointed Guardian of the said Benjamin ROCHELLE upon the resignation of said Amos ROCHELLE as guardian aforesaid, or to the said minors upon his arriving at maturity and after the payment and satisfaction in full of the claims and demands before set forth, then that he shall apply and appropriate the residue remaining in his hands should there be any to the payment and satisfaction of all the creditors, remaining to the said Amos ROCHELLE who shall presents their claims for payment after notice given by said Isaac ROCHELLE of any monies in his hands for distribution as aforesaid paying the same in proportion to their several amounts without preference or priority and should then remain int he hands of said Isaac ROCHELLE after the payment of all the claims an demands existing against said Amos ROCHELLE any money growing or arising from the sale aforesaid, that he will pay over the same to said Amos ROCHELLE or his meagan representatives. In testimony whereof the said parties to these presents have hereunto set their hands & seals this the day an year first herein before written.
