One undivided third part of fifty acres of land lying on the said creek joining the lands above mentioned being parts of said land given by the said Thomas Cunningham to Robert Kirkwood who died and who was brother of the said Mary. All parcels are in the town of Wilmington on the south side of Dock Street between Trent Street and the river adjacent to James Mitchell, Thomas Jennings and Joshua G. Wright. Also one half of a lot in Smithville in Brunswick County by the Number 19 adjacent Potts Street, Bay Street and Moore Street. Whereas the said Mary Kirkwood is also possessed of the following Negro slaves, a wench called Delia and a boy her own called John, a wench called Evelina daughter of said Delia and a girl called Peggy. Whereas a marriage is intended shortly to be had and solemnized between the said Joshua Potts and the said Mary Kirkwood. Whereas it is agreed between the said Mary and Joshua that if the marriage shall take place the said tenements, tracts, parcels of land, lots of ground, hereditaments and premises and also the said Negro slaves shall not be subject to the debts or encumbrances of the said Joshua Potts, nor to the disposition of the said Joshua except as herein after mentioned but that the same be settled to the use of the said Mary and Joshua during their joint lives and to the use of the survivor during his or her life and after the death of the survivor to the right heirs of the said Mary.
