Mason http://www.genrecords.net/emailregistry/vols/00022.html#0005225 June 28, 2022, 11:50 am Source: Rod Written: 1760 Transcribed by Sloan Mason slomas7@comcast.net Register of Deeds New Hanover Co., NC Bk.E, p. 33-34 Will of Joseph WATTERS of New Hanover Co., NC, St. Phillips Parish Written: 31 May 1760 Probated: March 1763 In the Name of God Amen, I, Joseph WATTERS in ye Province of North Carolina, New Hanover County, St. Phillips Parish, Planter; Calling to mind ye uncertainty & willing to settle my Worldly affairs do appoint his to be my Last Will & Testament in form & manner following: Imprimis, I give & bequeath unto my beloved Son Joseph WATTERS (born Nov. 23rd A.D. 1753) all my tract or parcel of Land whereon I now live Called Indian Town & half of the Island opposite the same to him his heirs & assigns and one fourth part of all my negro Slaves, Cattle horses or any other Stock I possess with the two Glasses now fixed -— hall & two mahogany Tables that are fellows? belonging to the same Hall an equal share of Beding with the rest of — them & — with the same proportion of anything not mentioned in this my Last Will & Testament to be paid him by my Execrs. hereafter mentioned whom he shall arrive to the years of Twenty one of age. Item: I give & bequeath to my beloved daughter Elizabeth WATTERS (born on Jan. 13th, 1757) on her day of marriage or when she shall arrive to ye sd. Twenty one of age an equal share or One fourth part of all my Negro Slaves, cattle, horses or any stock — with the dressing Table the Round Tea Table all the Tea Spoons , Strainer & Tongs of Silver made by me & all thirty cups saucers & Bowls that belong to my Estate with an equal share with her Brothers of y Beding or anything belonging to my Estate not mentioned in this my Last Will & Testament to e paid her on the day of Marriage or when she shall arrive to ye years of Twenty one of age by my Execrs hereafter mentioned. Item, I give & bequeath unto my beloved son Henry WATTERS one fourth part of all my Negro Slaver (he born on July 24th, 1758) Cattle horses or any other stock I possess so as to make him equal in his Legacy to any other of his Brothers & Sister, Except Lands which are to descend to him or the next heir at Law, to be paid him when he shall attain to the year of Twenty one of age. Item: I give & bequeath unto my beloved son George WATTERS, Born on Nov. 8th, 1759 One fourth part of all my Negro Slaves cattle Horses or any stock I possess to be paid unto him by my Execrs, hereafter mentioned as well as my son Joseph, My daughter Elizabeth or Henry by Execrs hereafter mentioned when he shall arrive to y age of Twenty one years & I will that one Tract of land on ye S W of Rockey River on great PD containing 200 acres & one other tract of Land containing 400 acres in ye fork of Rattle Snake that makes out of Hoods Creek may be sold as soon as may be 7 the money arising from ye sd. sale after paying ye Quit Rents due on ye sd. lands is to be applied towards the Education of my Children by my Execr. or Execrs. & if any of my children should die before they receive their Respective share of Legacys that their share shall be in equal division of the dec’d. Estate among the survivor except my Lands called Indian Town which shall Decend to the Male heir of my Children & in case they shall all die without heirs then ye sd. land is to go to my daughter Elizabeth & for want of lawful heirs of her body the Land is to go to the next heir at Law to her or their heirs or assigns forever. I will that my Chair or Chairs be for ye use of my Sister Dalrymple whilst she continue on my plantation & has the care of my children & if she should die, leave my house & Plantation or refuse the care of my daughter Elizabeth or any other of my children until they are of age sufficient to be boarded at school then the Chair is to go to my Sister Lillington (It presumed that any daughter Elizabeth is to remain with my Sister Dalrymple whilst she pleases to keep her) all my Estate not mentioned in this Will is to be equally divided among my children except my large Table Spoons & large Soup Spoon which are for the us of my Sister Dalrymple whilst she remains in my house but are to be divided betwixt my Sons Henry & George & if either of them dies, under age my daughter Elizabeth shall have an equal share with the survivor & if ye other dies my son Joseph shall have an equal share of sd. Silver Spoons except what are given otherwise to my daughter; Lastly I nominate, constitute & appoint my Brother Samuel WATTERS, Henry HYNE, Alexander LILLINGTON, Benj. HYNE, & Hon. Samuel ASHE to be my Execr. & my son Joseph when he shall be of age by Law Sufficient to act as an Exect. to this my Last Will & Testament, Signed with my Hand & Seal this 31 day of May Anno Dom. 1760, In the 33rd Year of the Reign of our most Sovereign Lord King George the Second.
