Northampton County, NC - Deed - Brown, Samuel to Brown, Benjamin-1764 File contributed for use in USGenWeb Archives by Vikki Highfield This Indenture made the twentyeth Day of February in the year of our Lord Christ One Hundred Seven Hundred & sixty Four & in the fourth year of the reign of our Sovereign Lord George the third of Great Britain France & Ireland, King, Defender of the Faith &c. between SAMUEL BROWN & JEAN BROWN his Wife of Northampton County in the Province of North Carolina Planter of the one part & BENJAMIN BROWN of the state & county and Province afd, Planter of the second part Witnesseth that they the sd. SAMUEL BROWN & JANNE BROWN his Wife for and In consideration of the Sum of thirty Pounds Current Money to them in Hand paid by the sd Benjamin Brown at or before the Ensealing & Delivery of these presents the receipt whereof the sd SAMUEL BROWN & JEANE BROWN his wife doth hereby acknowledge & thereof & every part & parcel thereof doth hereby acquit exonerate & discharge him the sd BENJAMIN BROWN by these presents and by these presents hath Given & Granted bargained & sold & by these Presents doth give & Grant Bargaine & sell unto him the sd BENJAMIN BROWN his heirs & assigns forever that is to say one Tract piece & parcel of Land Lying in No ampton County in the province afd on the North side of the Indian Swamp Containing two Hundred Acres be the same more or less and bounded as followeth viz. Beginning at RICHARD MELTONs Survey at a Cypress in the sd Indian Swamp thence along a line of marked trees to a black Oak in the sd line then along that to a gum then down MELTONs Line to SAMUEL SIZEMOREs Corner then along the sd Line to a black Oak then along a new line to a Red Oak in the spring Branch then along the sd Branch to the swamp then up the Water Courses of the swamp to the first Station & is the Land that THOS. HART Deceased gave to his Daughter JEANE BROWN the part to these presents as by a Deed of Gift bearing date the twenty seventh Day of May in the year of our Lord one thousand seven Hundred & forty seven the sd BENJAMIN BROWN To have and to hold the afd Tract piece & parcel of Land with all woods ways waters & Water Courses Gardens Orchards Profits Commodities privileges and advantages with the appurtenances thereunto Belong to him the sd. BENJAMIN BROWN his Heirs & assigns the only profitable Benefit & behoof of him the sd BENJAMIN BROWN his heirs & assigns forever and the sd SAMUEL BROWN & JEANE BROWN his Wife for themselves their Heirs Extrs & admrs & assigns doth Covenant promise grant and agree to & with him the sd BENJAMIN BROWN his heirs & assigns in manner & form following that is to say that they the sd SAMUEL BROWN & JEAN his Wife at the time of the Ensealing & Delivery of these Presents hath in themselves good right full Power & lawful authority to give & Grant bargain & sell the aforesaid Tract piece & Parcel of Land unto him the sd BENJAMIN BROWN his heirs & assigns in manner and form aforesaid and that the sd Tract piece & parcel of Land will and so Shall forever be here after be & remain unto the sd BENJAMIN BROWN his Heirs & assigns free & clear & freely & Clearly Exonerated Discharged of & from all forever Gifts grants bargains sales _ and Utensils _ Wills bills Bonds Judgements & all other Incumberances whatsoever & lastly they the sd SAMUEL BROWN & JEAN BROWN his wife for themselves their heirs Exrs & admrs doth covenant Promise Grant and agree to & with him the sd BENJAMIN BROWN & JANE BROWN his Wife shall & will from time to Time & at all Times here after on the reasonable Request of him the sd BENJAMIN BROWN his heirs & assigns at his or their proper Cost & Charges make as acknowledge & execute all and every other act & acts Deed & Deeds thing & things Convenient & Conveniences assurance & assurances for the better & more perfect assuring & Conveying of the sd Tract piece and parcel of Land afd unto him the sd BENJAMIN BROWN his heirs & assigns forever by the Councill learned n the Law of him the sd BENJAMIN BROWN his heirs and assigns shall be advised devised Required.
