Northampton County, NC - Deed - Brown, Benjamin to Ruffin, Frederick-1769 File contributed for use in USGenWeb Archives by Vikki Highfield This Indenture made this thirtieth Day of December in the year of our Lord one thousand seven hundred and sixty nine by and Between BENJAMIN BROWN of the province of North Carolina and County of Northampton of the one part and FREDERICK RUFFIN alias OQUIN of the aforesaid province and County of Edgecome of the other part Witnesseth that for and in valuable consideration of the sum of two hundred and forty pounds proclamation Money of North Carolina in Hand paid by the said FREDERICK the receipt thereof the said BENJAMIN BROWN doth acknowledge himself his Heirs Exrs & Admrs fully satisfied contented and paid and doth forever acquit and discharge the sd Ruffin his Heirs Exrs & Admrs of and from the same now fore and the valuable consideration above mentioned the sd BEN. BROWN hath by these presents given granted bargained and sold and by these presents doth give grant bargain & sell unto him the said FREDERICK RUFFIN his Heirs and Assigns forever all that Messuage _ Tract piece and parcel of Land whereon the said BENJAMIN BROWN lately Dwelt lying in Northampton County in the Province aforesaid on the North side of the Indian Swamp containing two hundred acres be the same more or less and bounded as followeth Beginning at RICHARD MELTONS Survey at a Cypress in the Indian Swamp then along a row of marked Trees to a Black Oak in the Head Line then along that to a Gum then down MELTONs Line to SAMUEL SIZEMOREs Corner then along the said Line to a Black Oak then along a new Line to a red Oak in the Spring Branch then along the sd Branch to the Swamp then up the Water courses of the sd Swamp to the first Station also one other Tract or Parcel of Wood Land lying and being in the County and province aforesaid Containing One hundred & twenty five Acres be the same more or less Bounded thus on the Village Swamp otherwise called the Indian Swamp Beginning at a Cypress in the said Swamp then No 45D _ poles to a red oak RICHARD BRASWELLs Corner then along his Line north 27D 150 poles to his Corner Hickory in JOHN COTTONs Line then along this Line No 70 D 90 poles to his Corner White Oak then along another of his Lines No 20 D 150 poles to GEORGE STEVENS Corner Red Oak in the sd Line then along STEVENS Line No 70 D 83 poles to his Corner pine in he Village Swamp then along the various Courses of the sd Swamp to the first Station. The above said plantation and two hundred acres thereunto belonging is the said Land that THOMAS HART deceased gave to his Daughter JANE BROWN as by Deed of Gift bearing Date the twenty seventh Day of May in the Year of our Lord one thousand seven hundred & forty seven the other tract or parcel of Wood Land containing one hundred & twenty five acres is the same as taken by Deed bearing Date the twenty second Day of June one thousand seven hundred & forty nine from Earl Granville to HOWEL BROWN. To have and to hold the said three hundred & twenty five acres in the whole be the same more or less with the said plantation and Woodland with all Wood Ways Waters & Water Courses Gardens profits commodities privileges and advantages with the appurtenances thereunto belonging to him the sd FREDERICK RUFFIN his Heirs & Assigns forever and the sd BENJAMIN BROWN for himself his Heirs Exrs & Adms. and assigns doth Covenant promise Grant and agree to and with him the said FREDERICK RUFFIN his Heirs & Assigns in manner & Form following that is to say that the sd BENJAMIN BROWN at the Time of the issuing and delivery of these presents hath in himself good right & full power and lawful authority to give and grant bargain and sell the aforesaid Tract piece and parcel of land unto him the sd FREDERICK RUFFIN his Heirs and assigns in manner & form aforesd that the sd Tract piece & parcel of Land _ and so shall forever hereafter be and remain unto the said FREDERICK RUFFIN his Heirs and Assigns free and clear and freely and clearly exonerated and discharged off and from all former Gifts Grants bargains Sales _ & uses _ Wills Bills Bonds Judgements and all other Incumbrances whatsoever and lastly him the sd BENJAMIN BROWN for himself his Heirs Exrs Administrators doth Covenant & promise grant and agree to and with him the sd FREDERICK RUFFIN his Heirs and Assigns in manner and form following that is to say that he the sd BENJAMIN BROWN shall and will from Time to Time and at all Times hereafter on the reasonable request of him the sd FREDERICK RUFFIN his Heirs or Assigns at his or their proper Cost and charges make do acknowledge and execute all and every other Act and Acts Deed and Deeds Thing and Things Conveyance and Conveyances Assurance and Assurances for the better and more perfect assuring and conveying of the sd Tract Piece and parcel of Land aforesaid unto him the sd FREDERICK RUFFIN his Heirs and Assigns forever as by the Council learned in the Law of him the sd FREDERICK RUFFIN his Heirs and Assigns shall be allowed devised or required In Witness whereof I have hereunto set my hand & affixed my Seal the Day and Year above written. This deed from BENJAMIN BROWN to FREDERICK RUFFIN Alias OQUIN was proved by the oath of DAVID RICE and ordered to be Registered. This deed was duly registered April the 2nd 1771.
