Northampton County, NC - Wills File contributed for use in USGenWeb Archives by Bonnie Flythe Harrison, Fennell, Cook, Smith, & Ogburn vs. Vick & Haley To the worshipful the Justices of the Court of Pleas & Quarter Sessions for Northampton County- The petition of Charles Harrison & Patsey his wife, Isham Fennell & Charity his wife, Foster Cook & Sylvia his wife, Edward Smith & Nancy his wife & of Charles Ogborn & Angelica his wife. Humbly Complaining showeth your Worships that James Watkins Clark, late of the county aforesaid esquire, departed this life sometime in the year 1803 intestate being at the time of his death seized & possessed in fee simple of several tracts of land lying in the county aforesaid, which on the death of the said James descended to his two children James Watkins Clark & Eliza Clark, who have both since departed this life intestate without issue; & your Petitioners Patsy, Charity, Sylvia, Nancy & Angelica are sisters of the said James W. Who left no brothers & as such are entitled to an equal division of the said lands, together with another sister Eliza who married Newitt Vick & now resides with her said husband in the Mississippi Territory & with the heirs & representatives of the only other sister Sally who in her life-time intermarried with __________ Jordan & departed this life leaving an only daughter Nancy who has since intermarried with one Holliday Hayley & resides with her said husband in the state of Georgia & Your Petitioners further show that they are desirous of having their part or proportion of the said tracts of land laid off & allotted to them in severalty which on account of the said Newitt Vick & Eliza his wife & the said Holliday Hayley & Nancy his wife not being citizens or inhabitants of this state cannot be done without the assistance of this worshipful Court, the Tender consideration whereof & to the End that the said Newitt Vick & Eliza his wife & Holliday Hayley & Nancy his wife may ----- be compelled to appear & answer the premises & that your Petitioners may have their share or proportion of the lands aforesaid laid off & assigned to them in severalty May it please your Worships to make the necessary orders & decree-------------- Signed: P.
