Northampton County, NC - Wills - Benthall, William Thomas - 1924 Will of William Thomas Benthall STATE OF NORTH CAROLINA NORTHAMPTON COUNTY I, William T. Benthall of Woodland, N.C. being of sound mind and memory, but considering the uncertainty of my earthly existence, do make and declare this my last Will and testament in manner and in form following, that is to say; Item 1st. That my Executrix herein named shall provide for my body a decent burial suitable to my relatives wishes and pay all funeral expenses together with my first debts, whosoever and whomsoever owing of the first money that may come into her hands as a part and parcel of my estate. Item 2nd. I lend to my wife Martha S. Benthall all my real Estate I may have, her life. I give her my person property of every discription, all the money, bonds, notes, and mortgages, also all my house and kitchen furniture, after her death the following. Item 3rd. I give to my son Ralph B. Benthall the house and lot where he now lives, Bounded as follows, beginning at H. P. Dunning's home place on main st. running uptown 42 yards or more or less to an elm tree, has 3 chops on it, then north or back from st. to ditch. Then east to H. P. Dunning's line on back of his lot. It is to be as wide on back of lot as in front. Item 4. I lend to my son Ralph B. Benthall the following lands. My farm known as Eugene Bryant land. My farm known as the Baggett land in Hertford Co. his life, This is his share of my estate. Item 5. After the death of my son Ralph B. Benthall the lands lent to him shall to his children, If none come back to my Estate. Item 6. I give to my daughter Mae Benthall Whisnant my farm in Roanoke Township known as the Goodwin Powell home place. Item 7. I give to my daughter the remainder of my town lot where I live, known as as the A. J. Harrell home, and lastly I do hereby constitute my wife Martha Sarah Benthall my lawful Executrix without bond to all intents and purposes to execute this my last Will and testament according to the true intent and meaning of the same and every act and cause thereof. Hereby revoking and declaring utterly void any other wills and testaments by me heretofore made. In witness whereof I the said William T. Benthall do here unto set my hand and seal. This the 15th. Joyner STATE OF NORTH CAROLINA IN THE SUPERIOR COURT NORTHAMPTON COUNTY A paper writing to be the last Will and Testament of W. T. Benthall, deceased, is exhibited before me, the undersigned Clerk of the Superior Court for said county, by Martha S. Benthall the executrix therein mentioned, and the due execution thereof by the said W. T. Benthall is proved by oath and examination by W. M. Joyner and S. T. Joyner, the subscribing witness thereto, who being duly sworn, doth depose and say, and each for himself deposeth and saith, that he is a subscribing witness to the paper writing now shown him, purporting to be the last Will and Testament of W. T. Benthall; that the said W. T. Benthall in the presence of this deponent, subscribe his name at the end of said paper writing, which is now shown as aforesaid, and which bears the date of the 15th day of February, 1924. AND THIS DEPONENT FURTHER SAITH, that the said, W. T. Benthall the testator, aforesaid, did, at the time of subscribing his name aforesaid, declare the said paper writing so subscribed by him and exhibited to be his last Will and Testament, and this deponent did thereupon subscribe his name at the end of said Will, as an attesting witness thereto, and at the request and in the presence of said testator. And this deponent further saith that at the same time when the said testator subscribed his name to the said last Will as aforesaid, and at the time of the deponent's subscribing his name as attesting witness thereto, as aforesaid, the said W. T. Benthall was of sound mind and memory, of full age to execute a Will, and was not under any restraint, to the knowledge, information or belief of this deponent; And further these deponents say not.
