Northampton County, NC - Wills - Bolton, Augustus - 1928 Will of Augustus Bolton STATE OF NORTH CAROLINA, NORTHAMPTON COUNTY. I, Augustus Bolton, of the aforesaid County and State, being of sound mind and memory but considering the uncertainty of my earthly existence, do make and declare this my last Will and Testament: FIRST. My executrix hereinafter named shall give my body a decent burial suitable to the wishes of my friends and relatives. SECOND. I give and devise to my beloved wife, Cornelia Bolton, the James Bolton farm for her natural life upon the condition that she does not marry again, if she should marry again or at her death I give and devise said James Bolton farm to my three sons T. Bolton, J. S. Bolton and W. T. Bolton, Letta Bolton Lassiter and Mabel Bolton Hughes, one thousand dollars a piece; upon further condition that my three sons upon my death assume obligation and pay off all indebtedness against my estate. It is my will and desire that the amounts to be paid my daughters shall be a lien on said farm and the same shall be due and payable by my said sons at the death or marriage of my said wife. THIRD. I give and devise to my beloved wife, Cornelia Bolton, my home place where I now live, located in Woodland, N.C., to her during her natural life upon condition that she does not marry again and at her death or marriage it is my will and desire that my home place be sold at public auction to the highest bidder and the proceeds from such sales be equally divided among all of my children, share and share alike. FOURTH. I give and devise to the Bolton family the grave yard located on the Bolton farm, one-fourth of an acre, to be used as a burial ground forever. FIFTH. I give and bequeath to my three sons, T. Bolton, J. S. Bolton and W. T. Bolton all of my personal property of whatsoever kind to be divided equally among them, share and share alike, except my household and kitchen furniture which I give and bequeath to my wife Cornelia Bolton. Sixth. I do hereby constitute and appoint my beloved wife Cornelia Bolton my lawful executrix to carry out this my last Will and Testament without bond and hereby revoking and declaring utterly void all other Wills made by me. A paper writing purporting to be the last Will and Testament of Augustus Bolton, deceased, is exhibited before me, the undersigned, the Clerk of Superior Court for said County, by Cornelia Bolton the executrix therein mentioned, and the due execution thereof by the said Augustus Bolton is proved by oath and examination of S. T. Brittle and John H. Lassiter, the subscribing witnesses thereto, who being duly sworn, doth depose and say, and each for himself deposeth and saith, that he is subscribing witness to the paper writing now shown him, purporting to be the last Will and Testament of Augustus Bolton; that the said Augustus Bolton, in the presence of this deponent did subscribe his name at the end of said paper writing, which is now shown as afore said, and which bears the date of the 4th., day of February, 1928. AND THIS DEPONENT FURTHER SAITH, That the said Augustus Bolton testator, afore said, did, at the time of subscribing his name as aforesaid, declare the said paper writing so subscribed by him and exhibited to be his last Will and Testament, and this deponent did thereupon subscribe his name at the end of said Will, as an attesting witness thereto, and at the request and in the presence of said testator. And this deponent further saith at the same time when the said testator subscribed his name to the said last Will as aforesaid, and at thee time of the deponent's subscribing his name as attesting witness thereto, as aforesaid, the said Augustus Bolton was of sound mind and memory, of full age to execute a Will, and was not under any restraint, to the knowledge, information or belief of this deponent: And further these deponents say not. NORTHAMPTON COUNTY. It is therefore considered an adjudged by the Court that the said paper writing and every part thereof is the last Will and Testament of the said Augustus Bolton, deceased.
