Northampton County, NC - Wills - Bolton, Mahlon - 1922 Will of Mahlon Bolton Rich Square, N. C. August 16th, 1922 I, Mahlon Bolton, being in my usual health and of sound mind make this my last will and testament. I give and bequeath to Janie Bolton, my daughter all my insurance now carried in the Metropolitan Life Insurance Co. To my son, Leonard Bolton, my insurance in the New York Life Insurance co., is given. I give to my wife, Emma Bolton my insurance in the Jefferson Standard Life Insurance Co. as provided is said policy. She said Emma Bolton, is to have and hold during her natural life my present house and lot together with all furniture and property attached to said house and premises as it stands, provided, however that if she remarries she forfeits all claim to said house home and other property thereunto attached, and vacates the same. Not that I object to her marrying, for I do not, but if she marries, she should marry a man who could and would provide for her and not she for him. So in case off her death or marriage the said house, home and property there with is to be equally divided between my wife Emma. My son Leonard and my daughter, Janie Bolton, after my debts are paid. Should my wife, Emma Bolton continue to reside at our present home and not marry, then all property remaining, of whatever kind, is to be equally divided between Leonard and Janie Bolton, my son and daughter. Of course, my wife, Emma, can and will use and devise her own land, hired from her Fathers' estate, as she may like. I prefer that G. E. Midgett shall settle my estate. three pages. A paper writing purporting to be the last will and testament of Mahlon Bolton, deceased, is this day exhibited before me, the undersigned Clerk of the Superior Court and said County by Leonard Bolton his son and the due execution thereof by the said Mahlon Bolton is proved by the oath and examination of Lula P. Maddrey and R. K. Grant the subscribing witness thereto, who be duly sworn depose and say each for himself and herself deposeth and saith that he or she is subscribing witness to the paper writing now shown him purporting to be the last will and testament of Mahlon Bolton, deceased, and that the said Mahlon Bolton signed his name at the end of said paper writing now shown as aforesaid and which bears the date of the 16th day of August 1921. AND THE DEPONENT FURTHER SAITH, that the said Mahlon Bolton, the testator aforesaid, declare the said paper writing so subscribed by him and exhibited, to be his last will and testament, and this deponent did thereupon subscribe his name at the end of said paper writing as a subscribing witness thereto, and at the request and in the presence of said testator, and in the presence of each other. And the deponent further saith that at the same time when the said testator subscribed his name as aforesaid and at the time of deponents subscribing his name as a subscribing witness thereto as aforesaid the said Mahlon Bolton was of sound mind and memory, of full age to execute a will and was not under any restraint to the knowledge, information or belief of this deponent. NORTH CAROLINA, NORTHAMPTON COUNTY. In the matter of the Estate of Dr. Mahlon Bolton, late of the said county and state:- TO THE CLERK OF THE SUPERIOR CLERK OF NORTHAMPTON COUNTY:- I, Garland E. Midyette, do hereby renounce my right to qualify as executor of the last will and testament of my friend, the late Dr. Mahlon Bolton. This the 6th day of September 1921. Garland E. Midyette. I, the undersigned widow of the late Dr. M: Bolton do hereby renounce my right to administer on his estate and do hereby authorize and empower my son L. G. Bolton to settle said estate. This Sept. 5th, 1921. Emma Bolton, Widow. STATE OF NORTH CAROLINA, IN THE SUPERIOR COURT. NORTHAMPTON COUNTY. IN THE MATTER OF THE LAST WILL of Mahlon Bolton. It appearing to the Court by the oath and examination of Lula P. Maddrey and R. K. Grant the subscribing witness thereto, before J. T. Flythe, for mor Clerk of the Superior Court, that the paper writing propounded by the Executor therein named, is the last will and testament of Mahlon Bolton and that the same was duly executed by said Mahlon Bolton in the presence of said witnesses and that at the time of signing the same the said Mahlon Bolton was of sound mind. It is thereupon adjudged that the said paper writing by admitted to probate at the last will and testament of the said Mahlon Bolton, and the Executor therein named, G. E. Midyette renounced his right to qualify and the widow of the deceased Mahlon Bolton, Emma Bolton having renounced her right to qualify as administratrix, her son, L. G.
