Northampton County, NC - Wills - Bryant, Shade - 1922 (Former slave of Joseph H. Bryant and Margarett Jones.) Will of Shade Bryant STATE OF NORTH CAROLINA NORTHAMPTON COUNTY I, Shade Bryant of the above named County and State, being of sound mind and memory, but considering the uncertainty of my earthly existence do declare this my last will and testament as follows: FIRST: My Executor hereinafter named shall give my body a decent burial and apply the expenses of the same, together with all my just debts out of the first money that may come into his hands belonging to my estate. SECOND: My house and lot on the East side of the road leading from Rich Square to Woodland and known as the old Miles Bryant residence, containing one acre, I give and bequeath to my dutiful son Edmond Bryant. THIRD: I direct that my Executor (Hereinafter named) shall sell all my land situated on the west side of Rich Square- Woodland road, adjoining the lands of W. H. Evans, Sidney Bryant's heirs and others, containing 61/4 acres more or less, and out of the proceeds of said sale pay all my just debts, and the remainder divide equally between my son Edmund Bryant, and my daughters Blannie Bryant, now wife of Ed. Carmans. FOURTH: All the remainder of my property not mentioned above shall be divided equally between my son Edmund Bryant and my daughter Blannie Bryant, now wife of Ed. Carmans. FIFTH: I hereby appoint my son Edmund Bryant to be my lawful Executor to all intents and purposes to execute this my last will and testament according to the true intent and meaning of the same, and every part and clause therof to serve without security or bond. NORTHAMPTON COUNTY A paper writing purporting to be the LAST WILL AND TESTAMENT OF Shade Bryant, deceased, is exhibited before me, the undersigned Clerk of the Superior Court for said County, by Edmund Bryant the executor therein mentioned and the due execution thereof by the said Shade Bryant is proved by oath and examination of W. H. Evans and Walter J. Evans, the subscribing witnesses thereto, who being duly sworn, doth depose and say and each for himself deposeth and saith that he is a subscribing witness to the paper writing now shown him purporting to be the last will and testament of Shade Bryant that the said Shade Bryant in the presence of this deponent, subscribed his name at the end of said paper writing, now shown as aforesaid, and which bears the date of 20th day of March, 1922. AND THE DEPONENT FURTHER SAITH, That the said Shade Bryant the testator aforesaid, did, at the time of subscribing his name as aforesaid, declare the said paper writing so subscribed by him and exhibited to be his LAST WILL AND TESTAMENT and this deponent did thereupon subscribe his name at the end of the said Will as an attesting witness thereto, and at the request and in the presence of the said testator. And this deponent further saith, that at the said time when the said testator subscribed his name to the said last Will as aforesaid, and at the time of deponent's subscribing his name as attesting witness thereto, as aforesaid the said Shade Bryant was of sound mind and memory, of full age to execute a will, and was not under any restraint to the knowledge, information or belief of this deponent; And further these deponents say not. STATE OF NORTH CAROLINA IN THE SUPERIOR COURT NORTHAMPTON COUNTY IN THE MATTER OF THE LAST WILL OF SHADE BRYANT. It appearing to the Court by the oath and examination of W. H. Evans and Walter J. Evans the subscribing witness thereto, that the paper writing propounded by the Executor therein named, as the last will and testament of Shade Bryant and that the same was duly executed by the said Shade Bryant in the presence of said witnesses and that at the time of signing the same the said Shade Bryant was of sound mind. It is thereupon adjudged that the said paper writing be admitted to probate at the last will and testament of the said Edmund Bryant, and the Executor therein named qualify as such.
