Northampton County, NC - Will of Benjamine H. Ellis, 1845

Northampton County,   State of N. Carolina
 
In the name of God Amen  I Benjamine H. Ellis being of sound mind and 
disposing memory do make this my last will and testament
 
Item 1st  I do not wish any publick sale after my decease. I wish my Executor 
to sell my negroe slaves Dick and Milly, and any other property that I have 
that can be most conveniently spared by my dear wife, privately, and apply 
the proceeds to the payment of my just debts until they are all satisfied.
 
Item 2nd  For and an account of the love and affection I have for my dear wife 
Mary Ann it is my will that she have the balance of my estate real and personal 
of every kind and description during her natural life, and at her death she 
can dispose of one third of it to whom and in what manner she may think proper; 
but the remaining two thirds it is my will at the death of my wife Mary Ann, be 
equally divided between my two sisters Mary James, and Harriet Rawls if living, 
if they should not be living to be equally divided between their heirs.
 
Item 3rd  I do nominate and appoint my friend John Summerill (sp?) and Nathaniel 
Stephenson executors to this my last will and testament. In witness whereof I 
have hereunto set my hand & seal this 29th March 1845

Northampton County June Court 1845
This last Will & Testament of Benjamine H. Ellis was introduced into open Court 
and proven by the oath of Eth. W. Brittle & Wm. H. Gray the subscribing witnessed 
thereto and ordered to be certified and recorded at the same time came John 
Summerille (sp?)  into June Court and renounced his executorship to said will, 
and at the same time came Nathaniel Stephenson the other Executor therein named 
and qualified as the Law __________
