Northampton County, NC - Wills - Joyner, Barden - 1844 Barden Joyner's Will I Barden Joyner of the County of Northampton and state of North Carolina being of sound mind memory but considering the uncertainty of my Earthly existence do make and declare this my last Will and Testament in manner and form following that is to say - 1 Item - I give and devise to my beloved Wife Derushy Joyner one Bed and furniture, one Chest, one Horse, two Cows and Calves, two Sows and Pigs, five Sheep, and one years provisions. 2nd Item - I give and devise to my Eldest son Jesse E Joyner one hundred and twenty acres of Land whereon he now lives and one Bed and furniture to and to hold to him his heirs in fee simple forever. 3rd Item - I give and devise to my daughter Martha Sumner wife of Wilie Sumner one Bed and furniture, and one Cow and calf which she now has also ten dollars yearly for five years if her husband does not come for her, if he comes and carries her to the west then the same to be equally divide between my other heirs. 4 Item - I give and devise to my son Joseph B. Joyner one hundred acres of Land adjoining the Lands of David Gatling and Jesse E Joyner, also one Bed and furniture to have and to hold to him and his heirs in fee simple forever. 5th Item - I give and devise to my daughter Susan Joyner one hundred acres of Land adjoining the Lands of John Joyner and one Bed and furniture, to have and to hold to her and here heirs in fee simple forever. 6 Item - I give and devise to my daughter Julia C. Joyner one hundred acres of Land adjoining Jesse E. Joyner and Joseph B. Joyner and one Bed and furniture to have and to hold to her and her heirs in fee simple forever. 7 Item - I give and devise to my son Drury W. Joyner one Bed & furniture to him and his heirs forever. 8th Item - I give and devise to my son Jefferson Joyner one Bed and furniture and one negro Girl ame Siley to have and to hold to him and his heirs forever. 9 Item - I loan to my beloved Wife all the lands not given away by me in former Items during the term of her natural in in satisfaction for and in lieu of her dower and third of and in all my real Estate. 10 Item - I give and devise to my two youngest sons Drury W. Joyner and Jefferson Joyner all the Land loaned to my beloved Wife after her decease to be equally divided between them so that Jefferson take the House, to have and to hold to them and their heirs in fee simple forever. 11 Item - I loan to my beloved Wife all the negroes of which I may die possessed during the term of her natural life, then said negroes to be equally divided between my Children Jesse E. Joyner, Joseph B. Joyner, Susan Joyner, Julia C. Joyner, Drury W. Joyner, and Jefferson Joyner, to them and their heirs forever. 12 Item - My will and desire is that all residue of my Estate shall be sold and my just debts paid and if there should be any surplus remaining that such surplus be equally divided between my said wife and Jesse E. Joyner, Joseph B. Joyner, Susan Joyner, Julia C. Joyner, Drury W. Joyner, and Jefferson Joyner, to them and their heirs forever. In witness whereof I the said Barden Joyner do hereunto set my hand and seal this 23 day of February 1844. Lastly I desire that Harrison C. Lassiter should settle my estate.
