Northampton County, NC - Wills - Lassiter, James-1816 File contributed for use in USGenWeb Archives by Nancy Cagle Last Will and Testament (transcript) of James Lassiter dated April 19, 1816 I James Lassiter of the County of Northampton and State of North Carolina do make my last Will and Testament in manner and from following, to wit, - First, I lend to my wife Sally Lassiter during her natural life or widowhood the following negroes, Cadar, Rose, Creary, Elvin and Ione, also the sole use of all the land I possess lying in the fork of the road whereon my dwelling house stands together with the appurtenances therewith belonging, also the sole use and profits of my apple orchard standing on the land I purchased of my brother Willie Lassiter with a gang way or lain from the road to said orchard twenty feet wide. - Secondly, I give unto my son Willie Lassiter one negro man named Arthur (which he carried with him to Tennessee) also all the property I have heretofore given him, to him, his heirs and assigns forever. Thirdly, I give unto my son Enos Lassiter one negro boy named Bob (which he carried with him to Tennessee) also all the property I have heretofore given him, to him his heirs and assigns forever. Fourthly, I give and desire(?) to my daughter Mary Futrell (upon condition her husband Willie Futrell will receive five hundred dollars as in full payment of a bond which he now holds against me) one-half of the land I purchased of Laurence Smith, beginning at the lower end of said land and including the houses wherein the said Willie Futrell now lives to a dividing line to be run beginning at the Run of Bear Swamp, running a line to my line in the Pocoran, also one negro woman named Agg which she now has in possession with her increase from the sale hereof together with all the property she has heretofore had from me, to her, her heirs and assigns forever. Fifthly, I lend to my son Enoch Lassiter during his natural life the use of the land I purchased of my brother Willie (except the apple orchard and lain) also I lend my said son Enoch during his life one negro boy named Jerry. At the death of my said son Enoch, If he should leave any child or children, I give unto such children the property I have lend the said Enoch, to him or them and their heirs and assigns forever. Also the apple orchard and lain after the death or marriage of my wife. - Sixthly, I give and bequeath unto my son William Lassiter one half of the land I purchased of Laurence Smith, the upper end thereof including the land he has in cultivation. To a dividing line to run between my said son and my daughter Mary Futrell, also all my right interest and title to all the negroes I purchased of John Daniel (the said Daniel claiming the negroes under my fathers will) to my said son William his heirs and assigns forever. - Also all the property my said son carried with him when he left me. Seventhly, I lend my daughter Martha Wright during her life, two negroes, Olive and Priss, with their increase from the sale hereof, together with all the property she carried away with her previous to her last marriage. If my said daughter should die leaving a child or children, I give the property herein lent her to such child or children to him or them and their heirs forever. - Eightly, I lend my daughter Elizabeth Lassiter two negroes , Hannah and Harle, with their increase from the sale hereof, also two cows and calves, one chest and one bed and furniture all her own choice, to my said daughter during her natural life. If my said daughter should die leaving a child or children, then I give the property herein lent her to such child or children to him or them, their heirs or assigns forever. Ninthly, I give and desire to my son Jesse Lassiter all my land that I have not already given or lent away, and at the death or marriage of my wife, I give my said son Jesse the lands and plantation I have lent my wife lying in the fork of the road whereon my dwelling house stands; also I give my said son the following negroes, Peter, Shadrack, Agg (the elder) Alston and Simon, two cows and calves (say second choice) one bed and furniture (second choice) one mare called the Archy Filley, with the increase of the said negroes from the sale hereof, to my said son Jesse his heirs and assigns forever. - Tenthly, I give to my daughter Elizabeth Lassiter one colt called the Twig Colt. - Eleventhly, it is my further will and desire that my wife Sally pay all my just debts and funeral expenses out of such of my property as I have not already willed away, and the balance of any remaining, to remain in her possession and be at her disposal during her life. And at the death or marriage of my said wife, it (is) my will and desire that the negroes herein before lent her shall be equally divided among my following children, Willie, Enos, William and Mary the wife of Willie Futrell, to them their heirs and assigns forever. - Lastly, I do nominate my wife Sally Lassiter the only executrix of this my last will and Testament with full confidence that she will carry the same into full execution - and I do hereby acknowledge this above to be my last Will and Testament. - In witness whereof I have hereunto set my hand and affixed my seal this nineteenth day of April 1816. This last will and testament of James Lassiter (decd ??) was exhibited into Court and proved by the oath of Thomas Hughes and Edwin Lassiter the subscribing witnessess thereto, whereupon Sally Lassiter the executrix therein named was qualified according to law - ordered that said will be recorded.
