Northampton County, NC - Wills - McDaniel, Simon Peter - 1945 Will of Simon Peter McDaniel NORTH CAROLINA NORTHHAMPTONCOUNTY I, S.P. MCDANIEL, of the aforesaid County and State, being of sound mind but considering the uncertainty of my earthly existence, do make and declare this my last will and testament. ITEM ONE. My execteor hereinafter named, shall give my body a decent burial, suitable to the wishes of my friends and relatives, and pay all funeral expenses together with all my just debts, out of the first moneys which may come into her hands belonging to my estate. ITEM TWO. I give and devise to my beloved wife, Olivia McDaniel for and during the term of her natural life all of my properties both real, personal and mixed wheresoever situate; and after her death to my children, Stanley McDaniel, Roger McDaniel, Helen McDaniel, Marjorie McDaniel, and Margaret McDaniel in equal share and share alike. In fee simple absolute. ITEM THREE. I hereby constitute and appoint my beloved wife, Olivia my lawful execetor to all intents and purposes to execute this my last will and testament according to the true intent and meaning of the same, and every part and clause thereof, and request she be allowed to serve without bond- hereby revoking and declaring utterly void all other wills and testaments by me heretofore made. The paper-writing hereto attached and purporting to be the last will and testament of S.P. McDaniel, deceased, is exhibited before and the undersigned Clerk of the supereior Court of Northhampton County, North Carolina, by Stanley P. McDaniel on of the heirs , the executer therin named, having renounced, and thereupon the following proof thereof is taken by the oath and examination of R.C. Benthall, Jr. and David S. Griffin, the subscribing witnesses thereto as follows: NORTH CAROLINA, NORTHHAMPTON County. R.C. Benthall, Jr. and David S. Griffin being duly sworn, depose and say, and each for himself deposes and say, that he is a subscribing witness to the said paper-writing now shown him purporting to be the last will and testament of S.P. McDaniel and that he saw him execute (or heard acknowledge the execution of) this writing as his last will and testament, and that the affiant attested it in the presence and at the request of said S. P. McDaniel deceased; and that at the time of its execution (or at the time its execution was acknowledge) said S.P. McDaniel, was in affiant's opinion, of sound mind and memory.
