Scott & wife vs Jacob Fields Ex'r The petitioners state by way of amendment and supplement that at (blank) Term 1827 of the Worshipful Court they exhibited their petition in said court against Jacob Fields Jr. Ex'r of Jacob Fields dec'd setting forth the last will and testament of said Jacob which had been duly proven and the said Jacob Fields Jr. had qualified as Executor thereto, that by said will a legacy was given to Narcissa wife of your petitioner Benjamin, that the said legacy had been sold by said Executor and never accounted for to your petitioners and that said Executor had made no settlement with him on account of his interest in right of his wife under the said will all which will appear by reference to said will and said petition which your petitioners prays may be regarded as a part of this his petition, and your petitioners state by way of amendment that in and by said will the said testator gave and bequeath to his daughter Vashti a Negro girl called Phillis and her children named Harty and Ben, that said Vashti since the death of said testator died intestate and that her said legacy has been sold and disposed of by said Executor. And your petitioner shews unto your worships that the pet'r Narcissa is entitled to a distributive share of the said Vashti's legacy. Your petitioners pray your worships that the legatees of said Jacob Fields dec'd and the distributees of said Vashti viz: Hulda Fields widow of said Jacob, Richard W. Fields, Edward Simmons and Dorothy his wife, Rebecca Fields, James Scott and Ann his wife, Brice Fields and the said Jacob Fields Ex'r aforesaid may be made parties to their petition filed as aforesaid and this amended petition, and that an account may be taken of said assets as will between your petitioners and that the said Executor as with the said legatees and distributees aforesaid, and that your petitioners share of said testators estate may be ascertained and that a suitable contribution may be made by and between the said legatees and that the excess above his suitable quota of contribution may be ascertained and decreed to him, and that they may have such other and further relief as the nature of their case may require &c.
