This file was contributed for use in the USGenWeb Archives by: Fran Henderson fhenderson@ec.rr.com ==================================================================== State of North Carolina County Court Onslow County May Court 1819 The Answer of Lott Ballard to the Petition of Alex'r Henderson - This Def'd saving & reserving all manner of execption to the petition for answer thereto saith that he admits he is the administrator of Tho's Henderson dec'd - That sd Thomas left heirs as mentioned in the petition - That Moses Mount, & wife, __ Solomon & others claimed the Estate as mentioned in pet'n & have released to petn'r his fourth of the Estate - Def'd further saith he rec'd a considerable personal estate of sd Thomas which he sold for the sum of Six hundred & Seventy six dollars or thereabouts as will appear by his a/c [account] of sales Returned to this office - That he also rec'd many claims of different kinds belonging to the sd Thomas, consisting of notes judgments open accounts etc as will appear by an inventory returned to this office, Some of which were good and have been collected, but most of which were not good. - That some of sd claims are yet uncollected which may possibly be good but the result is uncertain & def'd has not been able to bring them to a termination - Def'd further saith that there is now a suit pending against him in the Federal Court where he necessarily incurs heavy expences & he has a right to retain a part of petitioners portion of the estate to defray a ratiable (? maybe it's reliable) proportion of those expences - Def'd also says that since his return home he has not been able to to arrange his accounts, or to state precisely what amt has been collected by him from the outstanding claims of the s'd Thomas nor to shew what amounts have been disbursed on a/c of the Estate, but these he will be ready to shew on affidavit or otherwise upon an a/c being taken by this Court - Def'd further answering says he has made to s'd petn'r large payments on account of his portion of the Estate & has advanced him considerable sums of money under an agreement & understanding that they should go in discharge of Petnr's claim & at Petnr's request has paid several debts of his, under the same agreement & understanding - and these several sums amount as Def'd believes to the full portion of Petnr's share or very nearly so - And if upon an a/c this def'd is still in arrear to petn'r he is willing to pay any balance & prays to be dismissed with his costs ______ for Def'd On the back Alex'r Henderson vs L.
