STATE OF NORTH CAROLINA, Court of Pleas and Quarter Sessions, Onslow County To the Worshipful, the Justices of the Court of Pleas and Quarter Sessions, of the County of Onslow: The petition of Susan Henderson Widow & Lewis H. Henderson, Benjamin R. Henderson, Nancy Henderson, Josiah S. Henderson, Alftred E. Simmons and wife Hulda, Lewis Mills Amin, of Minerva Mills Decd. and of Lewis Mills wife Alsey and Matilda C. Henderson last one infant by her next friend Susan Henderson of the County of Onslow respectfully sheweth unto your worships, that they are tenants in common, of the following named Slaves, viz: Ned, Betty, Hardy, Daphney, Emaline, Abner & Minerva which said Slaves have come to your petitioners in the proportion of one ninght part to each of them, and they are desirious of having a division or partition of said slaves, so as to alot and set apart to each of your petitioners, their respective shares or portion of said slaves in soveralty; or in case an actul partition of said slaves cannot be had, without injury to some of your petitioners, and a sale thereof may be deemed necessary, that the same be ordered by this worshipful Court, so as to secure to each of your petitioners their ratable share in sevaralty of the proceeds of such sale. To the end therefore, that a partition or division of said slaves may be made, as aforesaid; and that your petitioners may severally hold and enjoy their respective allotments, of said negroes or slaves, or of the proceeds of the sale of the same, in case such sale should be deemed necessary, in severalty; and that your petitioners may have such other and further relief in the premises, as the nature and circumstances of this case may require, and to your worships shall meet. May it please your worships to appoint three freeholders, unconnected with your petitioners, by consanguinity or affinity, who being first duly sworn, shall divide the aforesaid negroes or slaves, and allot to each of your petitioners his or her shares in severality, and make report thereof, to this worshipful court; and to confirm said report; or in case a sale of said slaves, should be deemed necessary, for equality of partition, to order the same, and to appoint some fit and proper person, to make said sale, and to convey to the purchaser or purchasers of said slaves, such title, interest or estate, as your petitioners had in the same, and to make a report of his proceedings therein, to this worshipful court, and to secure to your petitioners his or her shares in severalty, of the proceeds of said sale, according to the statute in such cases, made and provided.
