Term 1835 State of North Carolina Onslow County Court of Pleas & Quarter Sessions February Term A. D. 1835 To the Worshipful the Justices of the Court of Pleas and Quarter Sessions, for Onslow County. The petition of Lewis MILLS, William MILLS, John MILLS, Amos ASKEW & Holland his wife, Polly BASDEN, Nancy MILLS, Lightbourne? BASDEN & Betsy his wife, Sally MILLS and Morning MILLS, respectfully Sheath unto your Worships that James MILLS late of the County of Onslow on the _____ day of _____ A.D. 1834, departed this life leaving a Last Will and Testament and therein appointed some of your petitioners his Executors, of whom your Petitioner William MILLS alone qualified at the November term A.D. 1834 of this worshipful Court. Your Petitioners further show unto your Worships that after making and Execution of the said Last Will & Testament the Said James MILLS purchased and became Seized and possessed of the following tracts of lands viz one tract called the Barrow land, adjoining the lands of Thomas H. HILL, Jesse SANDLIN, and Murrills mill pond containing two pieces one of one Hundred and thirty acres more or less and the other of three hundred acres more or less; also one tract adjoining the lands of Lott GREGORY, & Lewis WHITFIELD being the place bought by the said James MILLS from Jesse GREGORY, containing one hundred and twenty five acres more or less; also another tract bought of Lemuel WILLIAMS adjoining the last tract, New River Swamp & Lott GREGORY'S land, formerly George MILLS containing one hundred & twenty five acres more or less, also one other tract adjoining the New River Swamp & the Wilder? land, being the tract bought of Amos ASKEW & Brice WILLIAMS, containing one hundred acres more or less, also one other tract the Peter EDWARDS tract adjoining the lands of Lewis MILLS & Bryan MILLS, containing one hundred acres more of less; also one other tract, bought of (James BASDEN-name crossed out) Lewis JONES, adjoining the lands of William MILLS & called the James BASDEN tract, contains three hundred acres more or less also three (3) tracts adjoining each other on the Juniper & Black Swamp adjoining the lands of Barfield FUTTERILL and John BROWN being the lands bought of Buckner HOUSE, Daniel BRADHAM & Jonah COTTLE; also on either tract called the King land, adjoining the lands of William MILLS and Mathew BASDEN containing one hundred and twenty five acres more or less, and bought of John KING; also one other tract containing one hundred and fifty acres more or less lying on Gould Swamp or pocosin adjoining the lands of Jacky JONES, Mathew BASDEN & patented by William MILLS, Sr.? also one other tract continuing forty acres more or less adjoining the Barnet land & James BROWN being the land bought of James BROWN all of which said tracts lie in the county of Onslow and are more particularly described in the deeds given to the said James MILLS, which your Petitioner are ready to produce when required and to which they here? leave to refer. Your Petitioners further Showed unto your worships that the said James MILLS died leaving your Petitioners Lewis WILLIAMS, Lott and John (his brothers) and Holland ASKEW (the only child of Jesse MILLS, the brother of the said James, who died in the lifetime of said James MILLS) and Betsy BASDEN (wife of Lightbourne? BASDEN) Sally MILLS and Mouring MILLS (only children of Daniel MILLS, a brother of the said James, who died in the lifetime of the said James MILLS) his heirs at law, and that he aforesaid tracts (the said James MILLS having died intestate as to them) have descended and came to your Petitioner as tenants in common, according to the following proportions viz the said Lewis, William, Lott, John, Amos ASKEW & Holland his wife, Polly BASDEN, Nancy MILLS being each entitled to one eighth of the aforesaid lands and Lightbourne? BASDEN, Sally MILLS & Mourning, being jointly entitled to the other eighth. Your Petitioners further show unto your worships that they are anxious, and desirous to have their respective shares, in and to the aforesaid tracts of land allowed, and set apart to them in Severalty, according tot he aforesaid proportions. Your Petitioners therefore pray your Worships to appoint, five commissioners unconnected with your Petitioners by Consanguinity or affinity, to divid & set apart to your Petitioners their respective Shares or proportions in and to the aforesaid tracts of land, in Severalty and that your Worships would grant such other & further relief in the premises, by the nature of their case may require and to your Worships shall soon meet according to the acts of Assembly in such case made, and provided; and your Petitioners will ever pray to.
