W Montfort State of North Carolina } Court of Pleas & Quarter Sessions -- County of Onslow -- } August Term 1839 To the Worshipfull the Justices of the Court aforesaid The petition of Frances Montfort humbly complaining, respectfull represents to your worships that some time during the year 1838 her husband William Montfort departed this life & that at the ___ (no number) Term of the same year letters of administration on his estate were granted to Edward W. Montfort, the said William Montfort having died intestate --- Your petitioner represents to your Worships, that her said husband William Montfort died possessed of the following negro slaves Viz. Dafney, Sam, Edney, Tealy, Dafney Jr, Hosey, Ellen, Craft Sam, Ada, Maria, Sarah, Sidney, Amy, Molcy, Albert, Phoby & her three children, Elias, Hannah, Peggy, Irsael? Amica & her child, Luke, Jim, Ann, Eli, Peter, Merely, Hester, Calvin, John, Terecy, Peter Jr. Your Petitioner represents to your worships, that she is entitled as the widow of the said William Montfort to one third of the aforesaid negro slaves, her said husband having left surviving him but one child the aforesaid Edward W. Montfort --- Your petitioner therefore prays your Worships, that you would appoint three free holders unconnected with the parties hereto, who shall divide the slaves aforesaid & allot to yr Petitioner her distributive interest, being one third of the same & that they make report of their proceedings in the premises to the next Term of this Worshipful Court -- Your Petitioner further prays yr Worships that a copy of this her Petition with Subpona to answer the same be served on the aforesaid Edward W.
