Clarissa was the daughter of Seth & Cear (Hadnot) Ward, David was the son of Col. George & Nancy Ann (Hall) Mitchell. (pmp) To the Worshipful the Justices of the County of Onslow. Humbly complaining shew unto your Worships your petitioners DAVID MITCHELL and CLARISSA his wife that on or about the month of October in the year 1786, SETH WARD father of your petitioner CLARISSA, died, having duly made and executed his last will and testament, which was afterwards duly proved in the County Court of Onslow and filed among the records of said Court. And your petitioners further shew, that there was contained in said last will and testament a clause in the following words. (Viz) "For each daughter when married to be "paid by my two sons GEROGE and SETH fifty" pounds apeice in a short time after "my sons come of age and have their fortunes" in their hands, I mean twenty five pounds apiece "to be paid by each of my sons to each of my daughters". And your petitioners further shew that CLARISSA one of your petitioners, is one of the daughters of said SETH WARD deceased, and that on the ___ day of December in the year 1808 she intermarried with your other petitioner DAVID MITCHELL, and became entitled to receive from the said SETH WARD and GEORGE WARD the sons of said SETH WARD deceased the sum of fifty pounds; twenty five pounds from GEORGE WARD, and twenty five pounds from SETH WARD. And your petitioners further shew that the said SETH WARD although bound as above refuses to pay unto your petitioners the sum of twenty five pounds on the day of their intermarriage and although often requested to pay said sum of twenty five pounds has and still does refuse to pay it, as in Justice he is bound to do. Your petitioners therefore pray your Worships to issue a Subpoena against the said SETH WARD commanding him to appear before your Worships on the second Monday of October next, there to abide the decision of your Worships, and further to decree and order as to your worships shall seem meet.
