Where upon John decd as of the executors there in named. Qualified as in the law and such. Test (signed) D W Landlin, clk) In the name of God amen. I John Bender Senior of the County of Onslow and State of North Carolina, considering the uncertainty of human life being of sound mind and disposing memory though adoned in age do while propering has inestimable (? Jh) make and ordain this my last will and testament in ending to dispose of my wordly affairs not as human may prompt by as Justice equity shall sum to direct. First, I give and confirm to my son Martin Bender a tract of land in the County of Onslow where I* formerly lived more or less him his heirs and apigns I also bequeath him one Negro by the name of Isaac him and apigns forever. Secd. I give and confirm to my son John Bender the tract of land where he now lives in the county of Jones (NC) his heirs and apigns also one Negro woman named Violet him and assigns. Third. To my son Lott Bender is now in existence or if he at this time or date of this will lawful issue in marriage being, I devise the lands I now live on in the County of Onslow aftr the decase of my wife Mary Bender, his heirs and apigns but of those persons attended to in this item are no more. Then after the decease of my wife Mary who has a complete bona fida life in the said lands, to be sold by my executor provide of sales after deduting charges to be equally divided between my wife Mary Bender also my sons, Martin John Lott Linus Parker Liske and Margaret each an equal divided heirs and assigns. Fourth To my said son Lott Bender appears to be in esitance at the date of this will or his lawful apue at this date then I bequeath him my Negro Peter, but until he appears or his heirs as afore said will produce said Negro Peter to be bond out by my wife Mary proceds of heirs, to be equally divided between them one moity to his, the other to him or lawful heirs, but further it is my will that in case said Lot Bender of his lawful aspar do not or be properly acertain said Negro Peter so be sold by my executor proved of sale equally divided among my wife Mary my afore named heirs named in the preceeding item the named heirs and apaigns. (Page 2) Fifth. I bequeath to my wife Mary Bender one Negro woman Sukie, one bed and furniture her choice her trunk one table that the (unreadable) now accipers, one sow and calf her choice, one pot (one spider one pan of soothing irons, one pitcher her choice six calfes her choice and (unreable) six knieves and six forks two tumblers one decanter one dish and one tea pot one of one hoe one grubbing hoe three or six flag bottom chairs, six towls one tray face cracking basots her choice one brass candlestick one coffee mill one pair of billows heirs and apigns forever. Sixth. Residue of my estate vail of personal not specity bequeath as aforesaid dipose of I authorizing executor to sale on a credit of six months parcels of said or sale after deductin newpang champel or lawful commission to be set off and equally divided into seven distinct lots. Once divided to my wife Mary Bender one divided to son Martin one divided to son John one divided to son Lot and other to son Linus Parker one other to daughter Lisie one other to daughter Margaret their heirs assign. Seventh. My affairs will and ordain or desire that representatives in will controvances that may take place in distribution of my estate that thus depose and judgement of explanation in putin their distributions of shares to heirs of ligaters (can’t read) onr will shale be found and conclusion without the interferces of any court of judictions whatsoever. Eighth. I constitute my son John Bender and wifes brother Joseph Lay executors of this will revoking all other. In testimony, I the said John testator aforesaid set my hand and affix the seal as drawn in a circle the 4th day of March 1827.
