Freshwater 1885 Book of Wills Page 343 (end of page) In the name of God Amen. I, John A. Freshwater of Onslow County, North Carolina being of sound mind, but calling to mind the uncertainty of life, do make this my last will and testament. Item, I give and bequeath to my son George B. Freshwater a piece of land on the western side of my tract, beginning at the Clara Taylor branch when it crosses the road leading from my house to Queen’s creek church, running with the road to its intersection by a branch in which a large black gum tree stands on the right hand side of the road and a large water oak near, thence running due west to the Willis’ line, thence southerly with the Willis line to the Sanders’ line thence Easterwardly with the Sanders’ line and R. W. Freshwater line to the beginning. Item, I give to my daughters, Sally A. Meadows, Mary J. Riggs, and Martha W. Hancock all the rest and remainder of my land lying on the West side of the road leading from my house to Queen’s Creek church. Item, I give and bequeath to my daughter Julia J. Holland, and W. Alice Freshwater all my land lying north of Parrot’s swamp, known as Scott’s neck, commencing at the place where the last branch between my house and the sand hills crosses the road, about a mile from my house, running (end of page) down this branch, which I call the main stream of Parrot’s swamp, to the meadow road, and the ford or crossing place now in use, thence with the meadow road northwardly to the flat laurel, thence around said laurel to Sanders’ line and with his line to road leading to Queen’s creek creek church, thence southwardly with the road to the beginning. Item, I give and bequeath to my son Asher D. Fresh- water, all the remainder of my land lying on the north side of the Parrot’s swamp, and east of the meadow road, adjoining the land devised and given to my daughters Julia J. Holland and W. Alice Freshwater. Item, I give to my daughters Emma F. Freshwater and Virginia E. Freshwater all my land on the south side of Parrot’s swamp, beginning where the Parrot’s swamp branch crosses the road leading to Queen’s creek church, running down the swamp to R. W. Freshwater’s line, thence southerly with his line, and the line of the heirs of my son Ottaway Fresh- water to the road, thence northwardly with the road to the beginning. And it is my will and wish that if my daughter W. Alice Freshwater desires to live on the premises and with my daughters Emma and Virginia that she have the right to do so, as long as she remains unmarried. And I further will that should my daughter Emma F. Freshwater die without hiers of her body, that her share of (end of page) land shall go to my daughter Virginia E. Freshwater, and should my daughter Virginia E. Freshwater die without heirs of her body, her share of land shall go to my daughter Emma F. Freshwater. Item, To my son Robert W. Freshwater, as he has nearly, if not quite had his hare of my real estate, I give and bequeath Five dollars, and constitute and appoint him Executor of this my last will and testament. Item. I desire my Executor to sell the Thomas Owen’s tract of land, lying on the west side of Queen’s creek below Rich island, on such terms as may seem best, and divide the proceeds between himself, and my daughters, W. Alice, Emma F. and Virginia E. Freshwater, in equal parts. Item, I give and bequeath all my stock, farming tools, household and kitchen furniture, and per- sonal property of all description to my daughters W. Alice Freshwater, Emma F. Freshwater, and Virginia E. Freshwater in equal portions. Item, I have given to the heirs and widow of my son Ottaway Freshwater this portion of my land. Dated January 15th 1886. Witnesses. John A Freshwater (seal) Edward B. Sanders David J. Sanders (end of document) Additional Comments: List of persons as they first appear in the document: John A. Freshwater (testator) George B. Freshwater (son) Sally A. Meadows (daughter) Mary J. Riggs (daughter) Martha W. Hancock (daughter) Julia J. Holland (daughter) W. Alice Freshwater (daughter) Asher D. Freshwater (son) Emma F. Freshwater (daughter) Virginia E. Freshwater (daughter) Robert W. Freshwater (son) heirs & widow of Ottaway Freshwater (son, unnamed) Edward B. Sanders (witness) David J. Sanders (witness) It appears that the body of the will was written by someone other than John A. Freshwater or either of the two witnesses. Because of the way the first name is written for the witness, David J. Sanders, I am not absolutely sure that the first name isn't "Daniel" instead of "David".
