In the Superior Court. A paper writing purporting to be the last Will and Testament of Caroline S. Freshwater, deceased, is exhibited before me, the undersigned, Clerk of the Superior Court for said county, by Kate Russell, the executrix therein mentioned, and the due execution thereof by the said Caroline S. Freshwater by the oath and examination of E W Provost & E J Riggs, the subscribing witness thereto, who being duly sworn, doth depose and say, and each for himself deposeth and saith, that he is a subscribing witness to the paper writing now shown him, purporting to be the last Will and Testament of Caroline S. Freshwater; that the said Caroline S. Freshwater, in the presence of this deponent, subscribed her name at the end of said paper writing, which is now shown as aforesaid, and which bears date of the 14 day of March, 1908 . AND THIS DEPONENT FURTHER SAITH, That the said Caroline S Freshwater the testator aforesaid, did at the time of subscribing her name as aforesaid, declare the said paper writing so subscribed by her and exhibited to be her last Will and Testament, and this deponent did thereupon subscribe his name at the end of said Will, as an attesting witness thereto, and at the request and in the presence of said testator. And this deponent further saith, that at the same time when the said testator subscribed her name to the said last Will as aforesaid, and at the time of the deponent’s subscribing his name as attesting witness thereto, as aforesaid, the said Caroline S. Freshwater was of sound mind and memory, of full age to execute a Will, and was not under any restraint, to the knowledge, information or belief of this deponent: And further these deponents say not. It is therefore considered and adjudged by the Court that the said paper writing and every part thereof is the last Will and Testament of Caroline S Freshwater, deceased. Let said Will, together with the probate, be recorded and filed. This 23 day of March, 1929. JRGurganus Clerk Superior Court. (end of document) North Carolina, # # Onslow County, # I, Caroline S. Freshwater of the county of Onslow, State of North Carolina, being of sound mind and memory, but considering the uncer- tainty of my earthly existence, do make and declare this my last will and testament, in manner and form following, that is to say: First:- I direct my executrix, herein after named, to pay all my just debts, to whomsoever owing, out of the first moneys that shall come into her hands as a part or parcel of my estate. Second:- I give and bequeath to my husband Robert W. Freshwater, in the event that he live longer than I do, the sum of Twenty-five Dollars in money, to be paid to him as soon after my death as may be convenient. Third:- I give and devise to my daughter Kate Russell and to her husband Daniel W. Russell all that certain tract or parcel of land, known as the Jabez Bridge land, situate in Onslow county, State of North Carolina, and more particularly described in a deed from Ed- ward B. Sanders, James B. Howard and wife Arabella, David J. Sanders and wife Cora L., and Jackson Johnson and wife Alice J. to K.Caroline Freshwater, which said deed is dated the 20th , day of November 1885, and registered in the office of the Register of Deeds of Onslow county, State of North Carolina, in Book No.45 at page 225, to which said deed a reference is to be had for the description of the said lands: To have and to hold the said tract or parcel of land and all the privileges and appurtenances thereto belonging to the said Kate Russell and to Daniel W. Russell, their heirs and assigns in fee sim- ple forever. Fourth:- I give, devise and bequeath all the residue and remainder of my property, real, personal and mixed, wheresoever the same may be at the time of my death, to all my children, to be divided among them share and share alike, and in the event that either of my children should die before I do, then in that event the children, if any left, by the one dying prior to my death shall take the part of their parent. Lastly:- I do hereby constitute and appoint my daughter Kate Rus- sell my lawful executrix to all intents and purposes, to execute this my last will and testament, according to the true intent and meaning of the same, and every part and clause thereof – hereby re- voking and declaring utterly void all other wills and testaments by me heretofore made. In witness whereof, I, the said Caroline S. Freshwater, do hereunto set my hand and seal, this the 14 day of March,A.D., 1908. Caroline S.
