The personal and mixed property, I give to her desiring her to carry in the business I am now engaged in, namely farming, and be- lieving that her skill and judgement will enable her to rear and educated our children from the proceeds of the farm. Should this be found impossible, however, I desire her to exercise her jugment about the disposition of the property, keeping the real property for our children after he life estate therein is de- tearimed. And I do nominate, constitute and ap- point my said wife sold executrix of this my last will and testament, and it is my further will and desire that my said wife, be appointed, and she is hereby appointed and constituted Gurdian of all our children until they arrive at the age of Twenty one years. I desire my Executrix to pay all my just debts out of the first moneys that may come into her hands as a part of my estate. Revoking and declaring void every other will at any other time heretofore made by me. I do declare this to be my last will and testament. Sanders [his signature] [end of document] [start of document] No.79.--PROBATE OF WILL.--Printed and for sale by Edwards & Broughton, Printers and Bidners, Raleigh, N.C. --- STATE OF NORTH CAROLINA, } Onslow County } A paper purporting to be the last Will and Testament of Benjamin Haskins deceased, is exhibited before me, the undersigned, Clerk of the Superior Court for said County, by Caroline Freshwaters formerly Caroline Sanders Haskins, the executrix therein mentioned, and the due execution thereof by the said Benjamin Haskins by the oath and examination of E. B. Sanders & D. J. Sanders the subscribing witnesses thereto, who being duly sworn, doth depose and say, and each for himself deposeth and saith, that he is a subscribing witness to the paper-writing now shown him, purporting to be the last Will and Testament of Benjamin Haskins that the said Benjamin Haskins in the presence of this deponent subscribed his name by mark ["by mark" is written in above line] at the end of said paper writing, which is now shown as aforesaid, and which bears date of the 21st day of May, 1877. And the deponent further saith, That the said Benjamin Haskins the testator aforesaid, did at the time of subscribing his name as aforesaid, declare the said paper-writing so subscribed by him, and exhibited, to be his last Will and Testament, and this deponent did thereupon subscribe his name at the end of said Will, as an attesting witness thereto, and at the request and in the presence of the said testator. And this deponent further saith, that at the same time when the said testator subscribed his name to the said last Will as aforesaid, and at the time of the deponent's subscribing his name as an attesting witness thereto, as aforesaid, the said Benjamin Haskins was of sound mind and memory, of full age to execute a Will, and was not under any restraint, to the knowledge, information or belief of this deponent: And further these deponents say not. ["Onslow" hurriedly written.] It is therefor considered and adjudged by the Court that the said paper- writing and every part thereof is the last Will and Testament of Benjamin Haskins, deceased. Haskins 1877 --- Probated Aug 6 1902 Recorded in Book of Wills Page 479 [end of page] Additional Comments: Benjamin Haskins was the first husband of Kitty Caroline Sanders, the daughter of Isaac Newton Sanders, Jr. E. B. Sanders (Edward Benjamin) was her older brother and D. J. Sanders (David John) was her younger. At the time of the probating of this will, K. Caroline Sanders Haskins was married to Robert W. Freshwater, of Onslow County. Interesting to note that the above will was dated 21 May, 1877, but two other sources list his death as being in April of 1877.
