Onslow County, NC - Josiah Henderson Jr. Estate, 1851 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Estate of Josiah Henderson Jr. 1851 State of North Carolina Onslow County Court of Pleas and Quarter Sessions December Term, A.D. 1851 To THE WORSHIPFUL, the Justices of the Court of Pleas and Quarter Sessions of Onslow County: The Petition of Alfred E. Simmons and Benjamin R. Henderson Administrators of Josiah Henderson Deceased of the said County of Onslow respectfully shew unto your worships that the said Josiah Henderson Deceased departed this life on or about the ___ day of 1850 intestate and at the Term 18__ of this worshipful Court letters of Administration were duly granted to your petitioners of the goods and chattels rights and credits of the said deceased all which they accordingly took into their possession. Your petitioners further shew unto your Worships that they have duly advertised and sold according to law the perishable estate of their said intestate and called in the debts due by him and assertained as far as may be, what ammount of the claims due the estate of the said deceased will be available for the payment of the said debts, that your petitioners have further by order obtained from this worshipful Court, advertised and sold according to law the whole of the personal estate of of said intestate which has come into their hands as administrators as foresaid, excepting his slaves, and have applied the proceeds thereof in due course of administration to the payment of the debts of the said intestate and ther yet remains of debts unpaid and claims outstanding against the estate of the said intestate over and above the perishable and other personal property so applied as above set forth about the sum of two hundred dollars. Your petitioner further shew unto your Worships that in order to enable your petitioner to meet the payment of the said deficit so due from the estate of their said intestate it will be neccessary to sell the following named slave, to wit: Harriet. The proved arising from which your petitioners hope and beleive will be amply sufficient to make up the said deficiency. Your petitioners therefore pray your worships duly to consider the premises and to grant to your petitioner and order for the sale of aforesaid slaves. according to the Act of Assembly in such cases made and provided; and to make such other and further order and decree therein as the nature and crcumstances of this case may require.
