Onslow County, NC - Lemuel Henderson Sr. 1861 ~~~~~~~~~~~~~~~~~~~~~~~~~~ Will of Lemuel Henderson Sr. 1861 I Lemuel Henderson of the County of Onslow and State of North Carolina Being of sound mind and perfect memory do make and publish this my Last Will and Testament in manner and form following, that is to say: Iten 1st That I have allready given in advance to my son Issac Henderson one hundred and eighty five dollars in cash also one bay horse valuation seventy five dollars one bed & furniture valuation twenty five dollars & cow & calf valuation ten dollars the whole amounting to two hundred & ninety five dollars of which I intend shall stand as his share of my property or estate at my death provided it should be and equal share with the balance of my children (hereafter named) if he the said Issac Henderson's part allready given him by me should be more than the balance of my children will have at my death he the said Issac Henderson must pay over to them so as to make them & him the said Issac Henderson equal & if what he allready has is not enough to make him the said Issac Henderson Equal with the balance of my children, they must pay over to him to make him the said Issac Henderson Equal with the balance of my children Item 2nd I have allready given in advance to my son Nathaniel Henderson fifty three dollars in cash one bed valuation fifteen dollars & one cow & calf valuation ten dollars the whole amounting to seventy eight dollars which amount I want taken from my son Nathaniel Henderson's part of my estate or property so as to make him the said Nathaniel Henderson & the balance of my children Equal at my death Item the 3rd I have allready given my Daughter Elizabeth Ann Oliver one cow & calf valuation ten dollars which amount I want taken from her the said Elizabeth Ann's part so she may only be Equal with the ballance of my children Item the 4th I leave to my wife Mary Henderson her life right in my lands according to Law and one years support for herself & family her thirds of land to be set up by a Jury & her years support by commissioners appointed by Law Item the 5th All the balance of my property not heretofore disposed of in Items 1,2,3 both real & personal my wish and desire is that my Executors hereafter to be named to sell or otherwise so as to give an Equal division to the balance of my children viz: Elizabeth Ann, & Nancy C., James B., Gene H., Susan J., Lemuel 7 Franklin Hines Henderson Item 6th I do hereby nominate & constitute my Bro. Stephen Henderson & William Oliver my Lawful Executors to this my Last Will and Testament. H. Coston William Oliver In addition to the above distributions to my aforementioned children I the said Lemuel Henderson give in advance to my son James B. Henderson one bed & furniture valuation twenty dollars which amount must be deducted out of his the said James B. Henderson's part of my estate at my death so that he the said James B. Coston Arttus Littleton State of North Carolina, Onslow County, Court of Pleas and Quarter Sessions March Term 1867 A paper writing purporting to be the Last Will and Testamnet of Lemuel Henderson deceased is exhibited for probate in Open Court by Thomas Henderson Administrator with the will annexed. And the due execution thereof by the said Lemuel Henderson is proved by the Oath and examination of E.H. Coston one of the subscribing witnesses thereto. It is therefore ordered by the Court that the said paper writing in every part thereof is the Last Will and Testament of the said Lemuel Henderson and the same is ordered to be recorded and filed. And thereupon the said Thomas Henderson Administrator as aforesaid duly Qualifies as such by taking the Oath required by law. Signed: A.J.
