Seriously considering the uncertainty of human life at best more especialy my own in my declining & precarious situation do while in a firm state of mind & sound recollution make & ordain this my last will & testament, intending hereby to dispose of my worldly gains not as humar may prompt, but as justice and Equity shall seem to direct---- First of all, I most hymbly recommend my soul to the extensive mercy of that all wise Supreme inteligant Being who gave it me, most earnestly at the same time deprecating his justice. ITEM: I authorize constitute & appoint my Brother NICHOLUS H. MITCHELL and ROBT. DICKSON & their succesors & trustees giving & granting unto them full & discretionary powers at all times to controll & dispose of the following properity that shall be named in this clause for the benefit and use of my mother NANCY MONTFORT during the term of her natural life-that is to say, Negro CHARLES, his wife SILER, NAN & SANDERS, DEANA, SELAH & LUCY to be disposed of as before stated by my said Testers for the use & benefit of my said mother only, and in a manner they shall think best, at their discretion. ITEM: I authorize my said trustees to sell to the best advantage my moity of the land on plantation on New River in the County & State aforsaid after the decease of my mother or before if they think it expendent & convey the same to any purchaser they may contract with. The same and all the lands that was bequeathed my by the last will & testement of my father the late GEORGE MITCHELL, & with the proceedes pay my debts as far as it will extend, after deducting nessary charges and the surples if any in hand, be paid my mother as she may have occasion in small payments--- ITEM: I settle upon said trustee RO. DICKERSON, N. H. MITCHELL at their descretion one mare named Bets for the use occosionally of my mother NANCY MONTFORT during the term of her natural life. ITEM: I authorize my said trustees after the decease of my mother to sell off the negros and increase contained in the second item as a trust in equal dividends if they can so apporiation it to each of my brothers & sisters, but if it can not in their openion be fairly done, then said trustees are impowered to sell said trust to the best advantage in their power & at their descretion after deducting charges the net proceeds to be divided equally betweem my brothers & sisters afore said, then their heirs & assigns forever. ITEM: I give & bequeth to REBECCA BURKS thirty dollars for her heirs & assigns forever.
