Onslow County, NC - Will of Asher H. Simmons 1956 ~~~~~~~~~~~~~~~~~~~~~~~~~~ Asher H. Simmons Will 1950 I Asher H. Simmons in the County of Onslow and State of North Carolina, considering the uncertainty of this mortal life, and being of sound mind, do make this my last will and testament First I direct that funeral charges be taken from my burial insurance in the Onslow Mutual Burial Association of Jacksonville, N.C. Second I give to my sister Clara Simmons all of my 1/2 interest in land left to me by my stepmother (Lucy D. Simmons) also the one acre school house property. Third I give all of my personal property enumerated and all not mentioned in my will to my sister Clara Simmons that belongs to me viz; U.S. Bonds, safe, gun, pistol, adding machine, watches, money if any and all my insurance and any monies that might be in my Civil Service Retirement fund. Fourth I appoint my sister as administratix of my estate. In witness whereof I have hereunto subscribed my name this 16th day of August 1950. Signed: Asher H. Simmons Witness: E.M. SIMMONS, DECEASED A paper writing, without the necessary number of subscribing witnesses, dated the 16th day of August, 1950, purporting to be the Last Will and Testament of Asher H. Simmons, deceased, is exhibited in open court by Clara E. Simmons, the Administratrix thereing named; and it is thereupon proved by the oath and examination of the said Clara E. Simmons that the said Will was found among the valuable papers and effects of the said Asher H. Simmons after his death and it is further proved by the oath and examination of three credible witnesses, Mrs. Doris Canady, Miss Kate Bender and Mr. I.J. Kellum, that they are acquainted with the handwriting of the said Asher H. Simmons having often seen him write and verily believe that the name of the said Asher H. Simmons subscribed to the said Will and the said Will itself, and every part thereof, is in the genuine handwriting of the said Ashe H. Simmons. And it is further proved to the satisfaction of this court, by the evidence of the three last named witnesses, that the said handwriting is generally known to the acquaintances of the said Asher H.
