Ward of state and county above named being of sound mind and memory do make and declare this my last will and testament in manner and form as follows, that is to say First It is my desire that my just and lawful debts shall be paid out of the first moneys that may come into the hands of my executor who shall be hereinafter appointed. Item ___ I give and devise to my grand-son Richard Roberts Ward son of W. A. Ward deceased the following described tract or parcel of land lying in Swansboro Township Onslow County and bounded as follows to wit: Beginning at David G. Ward's corner and running North 55 degrees East eight & 37/100 chains with David G. Ward's line, thence south 45 degrees East twenty-two chains with the Freeman or Haygood line, thence continuing with said line, south 1 Degree 30' East forty-two and 20/100 chains across a portion of Brown Swamp to a dead pine stump thence south 27 degrees East thirteen and 7/100 chains to a chopped long leaf pine by the side of a road (?), thence south 39 degrees 10" West ten & 64/100 chains to a corner, thence south 37 degrees 20' East thirty-two and 40/100 chains to a fence thence south 43 degrees East forty-nine and 60/100 chains to a stake in the Marsh and on this direction to the __________ Sound thence with the Sound to a point situated south 39 degree East from the mouth of a ditch, thence running in this direction namely south 39 degrees West to the Mouth of said ditch, thence with said ditch North 45 degrees West one chain, thence North 63 degrees West one chain, thence North 66 degrees West one chain, thence North 55 degrees West one chain thence North 54 degrees West one chain thence North 39 degrees West twenty-two chains thence North 38 degrees West thirty-two & 80/100 chains thence North 10 degrees West sixty- nine chains crossing Brown swamp to a small oak tree, thence North 26 degrees 30' West to a stob on the side of the road near Prince's Pond thence with the various courses of this road to a lightwood tree in the edge of Camp branch thence with Camp Branch to light pocosin to a chopped pine, thence south 68 degrees East thirty-nine & 90/100 chains to the beginning. To have and to hold to him during the term of his natural life on the following conditions to wit: 1st that he pay to my beloved wife Ann J. Ward during the term of her natural life or widowhood a fair and reasonable yearly rent for the same: 2nd That he pay to Lina Taylor or her heirs one year after the death or marriage of the said Ann J. Ward the sum of Fifty Dollars with six per cent interest on the same for one year at the end of two years after the death or marriage of the said Ann J. Ward an other Fifty Dollars with like interest for two years, and so on until he shall have paid to the said Lina Taylor or her heirs the principal sum of Three Hundred and thirty-three dollars: 3rd That the said tract or parcel of land shall be held by my son R. E. Ward and in the event of his death by my son James M. Ward during the minority of my said grand son as Trustee for my said grand-son: And it is my will and desire that the Trustee herin named shall see that the above provisions in this item in this my last will and testament are truly Kept and performed by the said R. R. Ward to the said Ann J. Ward and to the said Lina Taylor or her heirs: Item, The tract or parcel of land above given and devised to my grand-son R. R. Ward during the term of his natural life I give and devise after his death to the lineal heirs of my said grand-son to have and to hold to them and their heirs. If however my said grand son shall die without lineal heir or heirs then in that event the tract or parcel of land so given and devised to my said grandson R. R. Ward I give and devise to my two sons R. E. Ward and James M. Ward: to have and to holdto them and their heirs, on condition however that the said R. E. Ward and James M. Ward or their heirs or the heirs of either of them shall take the said tract or parcel of land subject to the same conditions of the yearly rental to Ann J. Ward and a money payment to Lina Taylor or her heirs as ___ ________ in the devised herein above made to my said grandson R. R. Ward and after his death to his lineal heirs. Item. The residue of my real estate if any after payment of my just and lawful debts Whenever it may be situated I give and devise to my two grand children Richard G. W. McLean and Bertha Henderson, to have and to hold to them and their heirs subject to the dower right of my beloved wife Ann J. Ward. Item. I give and bequeath to Noah Kellum the sum of one Hundred Dollars in Money. Item - It is my wish and desire that my personal property after giving to my beloved wife her year's support shall first be applied to the payment of my just debts and the residue if any I give and bequeath to my two grandchildren R. G. W. McLean and Bertha Henderson as my own children who are not mentioned or provided for in this my last will and testament I have provided for during my life time what I have intended for them to have. Item All the residue of my estate real, personal. and mixed wheresoever it may be found and of whatsoever it may consist I give and devise unto my two grandchildren R. G. W. McLean and Bertha Henderson, to hold to them and their heirs forever. I hereby revoke all wills by me heretofore made and constitute and appoint my son R. E. Ward Executor of this my last will.
