This file was contributed for use in the USGenWeb Archives by: Beverly Cole ==================================================================== JAMES CHADWICK WILL State of North Carolina County of Onslow Will Book 1 I, James Chadwick, of the county of Onslow and State of North Carolina, being weak in body but of a sound and perfect mind & memory, and knowing it is appointed unto all men once to die, do make and publish this my last will and testament and revoking all others by me made, in manner and form following, that is to say I wish my body to be buried in a decent Christian like manner at the discretion of my friends and executors and what worldly estate I am blessed with in this life, I dispose of in the manner hereinafter (illegible) (viz.) (Illegible), I wish all my lands to be sold to the best advantage by my executors either at public or private sale, which they may think best calculated to advance the interest of my estate, and in such terms as the situation of my (businesses?) will (admit or administrate upon?). Also want my negro woman Bridget, my stock of all kinds and any other article which I may die seized and possessed of which I shall not hereafter specifically dispose of in some other way, to be sold by my executors and the money arising from the sale of the lands and other articles left to be sold in this clause of my will to be applied to the payment of my just debts and after they are paid, then the balance of the money remaining in the hands of my executors from the sale of the aforesaid lands & other property left to be sold to be equally divided between my wife and my three children provided my wife shall give her consent and convey her title to dower in the lands aforesaid to the purchase of the same, but in case she thereto refuses to convey such title, then & in that case, I wish the balance of my lands sold by my executors on the conditions aforesaid and the money arising from such sale to be the least of my estate applied towards the payment of my debts but equally divided amongst my three children. ITEM I wish all my negroes which I now have in possession except Bridget who is left to be sold to be equally divided between my wife & my three children to share and share alike and I do empower and authorize my executors to form a committee composed of themselves to make such division (having due notice?) to families as much as possibly they can so as to keep them together. Particularly my negro man John, his wife and family I wish allotted and set off to my oldest daughter Sarah, and if John and his family should amount to more in value than her (equitable?) share of my negroes, then in that case, I wish my executor to reduce the value of said family by commencing at their oldest boy and so on downwards untill they shall make her share only equal with my wife and two younger children. ITEM I wish the remaining part of my estate which may be due my children to be kept at lawful interest and the negroes to be annually hired out and the money arising from such hire & interest to be applied to the raising and educating of my children, which I wish by all means to be attended to by my executors and if they can not receive such education and remain with my relations I (illegible) (illegible) it, but in that particular, I leave my executors the sole arbiters. ITEM I ordain, constitute and appoint my friend and relation Allen Davis and my friend Daniel M. Dulany my executors to this my last will and testament.
