I, Eli Cox of Onslow County, being in a very low state of bodily health but of sound mind & memory & knowing it is appointed for all men once to die to make this my last will & testament in the following words that is to say… First of all, I recommend my soul to the hand of my redeemer & my body to its parent earth to be buried in a decent Christian like manner at the discretion of my Executor hereafter named and as to suching (?) as concerning such worldly estate as it has pleased God to bless me with in this life, I dispose of in the following manner that is to say… First, I lend unto my beloved wife Susan all & singular the property, negroes, stock of every description, furniture of every item, thing or things of any description be it more or less that I have in possession or have any right by law in the hands of the administrator of her former husband not valued, divided nor reduced to possession or elsewhere, wherever it may be that I got by my intermarriage with her the said Susan's death, I then give said property so loaned to her the said Susan with its increase if any to the child with which beloved wife is now pregnant to it, its heirs & assigns forever. Second, I desire my wife Susan should pay whatever debt or debts by her contracted before our marriage & now remaining unpaid without taking any of my property owned & held by me before our marriage to aid in such payment. And the better to enable her to make such payment or payments, I give & bequeath to her the said Susan all my crop of every description now standing & growing, housed & ready to house on the premises where I married her or adjoining thereto at Jesse Humphrey's old house being in cotton growth, the balance of said crop after the payment of the debt or debts first named, if any, I give to my wife, her heirs & assigns forever. It is also further my will & desire that my land & plantation on blue creek should be equally divided in quantity of acres between my two sons, namely Edward W. Cox & Daniel N. Cox, so as to give Daniel N. Cox that half, including the present dwelling house to them, the said Edward W. Cox & Daniel N. Cox, to them, their heirs & assigns forever. Also, further lend unto my beloved wife two negro slaves of my own family of negroes (viz.) Dick & Betsey during her natural life & at her death I then give said slaves Dick & Betsey & increase if any to the child with which she is now pregnant to it, its heirs & assigns forever. I also give to my wife one hundred dollars in money to be paid her by my Executors hereafter named to her, her heirs & assigns forever. I also give & bequeath to my daughter Emily N. Cox my negro slaves (viz.) Aner, Chany, Redding, Anne or Ame & Aggy to her, her heirs & assigns forever. I also give & bequeath unto my son Daniel N. Cox my negro slaves viz. Caty, Carolina & Jack - to him his heirs & assigns forever with their increase & C. It is also my will & desire that my daughter Emily have one half the rent of that part of my blue creek plantation bequeathed to my son Daniel N. Cox til he the said Daniel N. Cox arrives to the age of eighteen years (illegible) the said Emily should marry to her, her heirs & assigns forever. I also give Emily my daughter one horse cold about three months old called Major to be raised & used by her brother Edward when not in her immediate use. Where (illegible) use to her, her heirs & assigns forever. I also give Emily one feather bed & furniture to her, her heirs & assigns forever. I also give Edward W. Cox, one feather bed & furniture one man called Jim, my stock of cattle I bought with premises except one cow to him, his heirs & assigns forever. The cow last excepted I give to Emily, her heirs & etc. (?) forever. My other beds & furniture I leave to be sold & the profits there arising to go to my David N. Cox, his heirs & assigns forever. The corn & fodder due him for the rent of my blue creek plantation I leave to be sold & equally divided between my other children already named to them & their heirs & assigns forever. My geese at Gabriel Gray's I give to Edward W. Cox in like manner with his other gifts & etc. (?) I also give & bequeath to my friend James Glenn of Onslow County fifty dollars out of my estate to him, his heirs & assigns forever. The balance of my estate not herein disposed of, I give to David N. Cox & heirs forever. I also constitute & appoint my beloved son Edward W. Cox, Executor to this my last will & enjoining all other wills & acknowledging this to be my only will in testimony whereof I the said Eli Cox do here set my hand & seal. (signed) Eli Cox. Then was the will of Eli Cox offered for probate & the execution thereof duly proved in open court by the oath of W. T. Humphrey one of the subscribing witnesses & Edward W.
