I, James Mills, of Onslow County, being in a low state of bodyly health but of sound mind and memory, thanks be to God and knowing it is appointed for all men once to die, do make publish and declare this to be my last will and testament. That is to say, my body I recommend to its parent earth at the discretion of my executors and as touching my worldly estate, I dispose of it in the following manner, viz. First, it is my will and desire that my brothers Lott and John should have my land that I bought of Benjamin Barrino, equally divided between them upon their discharging my estate of a certain sum of money I am now owing of them (the crop therein excepted) to them, the said Lott & John Mills, their heirs & assigns forever. I also give unto my sister Polly Basden & her heirs lawfully begotten of her body the land that I bought of James Philyaw to be by her and them possessed during her and their pleasure or to be by her in the (necessity?) of her heirs possession or by her sold under the same restrictions as former caveats possess title to lands inherited by the death of parents. I also give my brother William Mills the land I bought of Jesse Basden (the crops therein excepted) to him, the said William, his heirs and assigns forever. My land, on which William King now lives, I wish to be sold by my Executors at public sale at six months credit, the price of which will be hereafter disposed of hereafter. I also leave my land that I bought at (executor?) sale sold by Lewis & Oliver being the land Evans (Hamby or Hansly?) sold to John King to be sold by my executors at six months credit & the price thereof to be hereafter disposed of. It is also my desire that if a title can ever be obtained in my name or to my (illegible) for the land of my father sold by Parrish the (District?) tax collector and bought by me, I give & bequeath unto Jesse Mills a small parcel thereof on the south side of my father's land beginning at Lawrence (House's?) line and running by the upper corner of Daniel Mills, deceased, field and to be (illegible) continue a straight line to the river swamp, and then down the line to Brice Williams land including all the land below the line running from Moores line by the corner of the Danl. Mills field to the river to the said Jesse Mills, his heirs & assigns forever. I also give to my brother Lewis Mills a part of the aforementioned tract of land beginning at House's line on the East side of Kinston Road and beginning by the lower corner of Owen field to a drain and down said drain to the river, all the land above said drain to said Lewis Mills, his heirs and assigns forever. Then all the land comprehended in the old William Mills claim sold by the collector and bought by me lying between the line given to Jesse and the line given to Lewis, I give and bequeath to my brothers Lott Mills & John Mills, their heirs & assigns forever. I also give to Lewis Basden the acre of land I have a deed for from Richard Basden in his own right & as special grandson to John together with the sum of twenty five dollars out of the money of my stocks and the use of negroes to assist him in (raising?) the mill dam and putting up a mill house at the mill, formerly Barrino Mill, and all my right to said mill & appurtenances to said Lewis Basden, his heirs and assigns forever. I also give to my brothers John & Lott Mills my negro man Jack, to them and their heirs & assigns forever and, in consideration of lands given to said Lott and John & negro Jack, then said Lott & John is to pay to Lewis Basden the sum of one hundred and fifty dollars & maintain my mother during her natural life. I give to my brother William my negro man Frank by the said William paying my sister Nancy two hundred and fifty dollars, which Negro Frank to the said William and money to the said Nancy, I give to them the said William and Nancy, their heirs and assigns forever. It is my desire that whenever William Basden, his agent, attorney or friend shall deliver to me or my executors a note I gave to said William for four hundred & fifty dollars, that my executors surrender to said William, his agent or attorney, the bill of sale given me for a certain negro boy Julius to be then and thereafter the property of said William Basden, clear of any claim of myself, heirs or assigns & for my executors to pay said William Basden at the rate of thirty five dollars per year for the service of Julius, I also give a negro girl Aggie to Lewis Mills his heirs and assigns forever. I give and bequeath my negro man (Dan?) supposing him to be worth five hundred dollars to be divided between Jesse Mills, Lewis Mills, Nancy Mills, Holland Mills in the following manner, viz. Holland to have -------------$200 Jesse to have ---------------$100 Lewis to have ---------------$100 Nancy to have ---------------$100 $500 I give to Lott Mills my young gray mare to him, his heirs and assigns forever. I give Lewis Basden out of the crop at the Barrino plantation thirty barrels of corn to him, his heirs & assigns forever, one fifth of the fodder & peas from said farm, all the rest in as much as is necessary of my crop to be disposed in fattening my stock fit for market. All the rest of my property not herein disposed of any description to be sold for the benefit of my creditors and if any remains to be equally divided between my brothers Jesse, Lewis, William, John & Lott & my sisters Polly and Nancy and to the children of my brother Dan Mills, deceased, the sum of one dollar cash & to my mother out of my estate twenty five dollars to them, their heirs and assigns forever. I also appoint my brothers William Mills, Lott Mills, & John Mills Executors to this my last will and testament denying all other wills and acknowledging this to be my will in witness whereof I hereunto set my hand and seal.
