I, Beneter Evans, of the county of Onslow and State of No. Carolina, being weake in body but in my proper mind and memory and knowing that it is appointed for all persons once to die, do make and ordain this my last will and testament in manner and form as follows, to viz. 1st, It is my desire that all my just debts be paid & burial expences. 2nd I give to my beloved brother and sister to viz., Samuel Evans and Sharlotte King, one dollar each to be paid by my executor or administrator hereafter named. I also give to the lawful heirs of my two brothers to viz., James Evans and Bryan Evans, deceased, one dollar to each set of children to be divided among said children. 3rd I give to my neace, Beneter Koonce, six head of cattle now in possession of my beloved Mother, also one bed and furniture, one sow and pigs. 4th I give to my nephew, John M. Frazure, one heifer and one bed and furniture. 5th It is my wish that all that I now have now in possession or may be entitled to by law of my Father's estate, at my decease may be equally divided between my neace Beneter Koonce and John M. Frazure, my nephew, that is not herein disposed of. 6th I give to my neace Beneter Koonce one Chirt and one trunk. I also give to her, the said Beneter, all of my wareing apparel at my death. Last of all, I constitute and appoint my friend E. W. Cox, my executor to this my last will and testament, denying all others, in witness whereof I have set my hand and seal in presence of Test: Gardner Shepard Test: William Shepard (signed her mark) Beneter Evans State of North Carolina} Onslow County} Court of Pleas & Quarter Sessions, May Term 1845} Then was the foregoing paper writing exhibitted in open court as the last will and testament of Beneter Evans , deceased, and the due execution thereof proved by the oath of Gardner Shepard, one of the subscribing witnesses thereto. It is constituted by the court that said paper writing is the last will and testament of Beneter Evans and the same be admitted to probate as such, whereupon it is ordered by the court that the same be recorded and filed as and for the last will and testament of Beneter Evans, deceased, at the same time Edward W.
