This file was contributed for use in the USGenWeb Archives by: Beverly Cole ==================================================================== JOHN GILBERT WILL State of North Carolina County of Onslow Will Book 2 In the name of God, Amen, this 8th of February AD 1852, I, John Gilbert Senior, of Onslow County, being in a perfect state of body and mind and memory, but knowing it is appointed for all men once to die, do make this my last will and testament in the following manner, my body I (space is blank here and appears to have been erased - bgc 11-13-2001) to its earth to be buried in a decent Christian like manner and as tuching such worldly estate as it has pleased God to bless me with in this life, I give and dispose of in the manner and on the conditions hereafter particularly described, that is to say ITEM first: I want all my funeral expences paid and all my just debts and also to have a decent set of tombstones placed at my head and feet. Second, I empower my executor to sell all my Negroes at privit sales, they having the right of choosing their owners, that is to say, Lucy Ann, her child & Will. ITEM third, I bequeath to my daughter Polly Packer, my Negro man Ceaser, also one hundred dollars out of the sale of my property. ITEM fourth, after the sale of my perishable property and Negroes, and the one hundred dollars to my daughter Polly and five dollars to my son in law Frederick Packer, the ballance to be equally divided between all my heirs at law, then living. I nominate and appoint my friend Robert White, to this my last will and testament, my sole executor, all of which I have distinctly read and approved of. In testimony whereof I the said John Gilbert Senior, have hereunto set my hand and seal the day and date above written. Ward Nancy Jane Sandlin State of North Carolina} Onslow County} Court of Pleas and Quarter Sessions September Term 1853 Then was the paper writing purporting to be the last will and testament of John Gilbert Sr., offered and admitted to probate on the oath of George I. Ward, the subscribing witness thereto and said paper writing ordered to be recorded and filed as the last will and testament of said John Gilbert, deceased, and Robert White the executor therein named appeared in open court and was duly qualified as executor aforesaid.
