This file was contributed for use in the USGenWeb Archives by: Beverly Cole ==================================================================== CHARLES GREGORY WILL State of North Carolina County of Onslow Will Book 2 State of North Carolina} Onslow County} March 7th 1859 Know all men by these presents that I, Charles Gregory of the County and State aforesaid, being of sound mind and disposing memory but considering the uncertainty of my earthly existence, do make and declare this my last will and testament in manner and form following, that is to say, First that my executor (hereinafter named) shall provide for my body a decent buriel, suitable to the wishes of my relations and friends, and pay all funeral expences together with my just debts, to whom owing out of the sale of such property as my executor hereinafter named may select. ITEM I loan unto my beloved wife, Henrietta Gregory, all of my property consisting of my lands, Negroes, horses, hogs, cattle, sheep, provisions on hand, crop, stock of all kind, household and kitchen furniture, to have and to hold to her the said Henrietta Gregory, for and during the term of her natural life. ITEM I give and bequeath unto my four grand children Julien, John C., Benjamin and Morning Gregory (children of my son Jesse A. Gregory) my two negro girls, Holland and Vilet, together with their future increase if any, to be equally divided between them, share and share alike to them, their heirs and assigns forever. ITEM I give unto my beloved daughters Mary Jane Cox, wife of Harvey Cox, during her natural lifetime, all of my lands together with the privileges thereunto belonging; then to the lawful begotten heirs of her boddy, my will and desire is that if my daughter Mary Jane Cox should die leaving no ishew, then my four grandchildren Julien, John C., Benjamin and Morning Gregory shall have all of my lands to be equally divided between them, share and share alike. ITEM I give and bequeath unto my beloved daughter Mary Jane Cox, during her natural life time, the following named slaves; Stephen, Tom, Prisciller and Oliver, then to go to the lawful begotten heirs of her body. My will and desire is if my daughter Mary Jane Cox should die leaving no ishew, the above named slaves, Stephen, Tom, Prisciller and Oliver should be equally divided between my four grand children Julien, John C., Benjamin and Morning Gregory, to be equally divided between them, share and share alike. ITEM I give and bequeath unto my beloved daughter Mary Jane Cox, during her natural lifetime, the following named slaves, viz., Mariah and her seven children, Betsey, Amanda, Philis, Charles, Susan, Caroline, and Frank and Betsey's two children, Lott and Mary, together with the future increase of the female slaves aforementioned, then to go to the lawful begotten heirs of her body. My will and desire is that if my daughter Mary Jane Cox, should die leaving no ishew, that Harvey Cox, her husband, shall have the slaves last named; Mariah, Betsey, Amanda, Phillis, Charles, Susan, Caroline, Frank, Lott and Mary. ITEM my will and desire is if my executor should consider it best, to sell any of my slaves to pay my debts, that Stephen and Oliver be first sold. ITEM I give and bequeath unto my beloved daughter Mary Jane Cox and all property belonging to me, not other wise disposed of in this will to her and her heirs and assigns. And lastly, I do hereby constitute and appoint my trusty friend Harvey Cox, my lawful executor to all intent and purposes to execute this my last will and testament according to the true intent and meaning of the same hereby revoking and declaring utterly void all other wills and testaments by me heartofore made. In witness whereof I the said Charles Gregory set my hand and seal in the presents of Joseph Mumford William Jarman (signed) Charles Gregory State of North Carolina} Onslow County} Court of Pleas and Quarter Sessions June Term 1859 A paper writing purporting to be the last will and testament of Charles Gregory deceased is exhibited for probate by Harvey Cox, the executor therein named and the due execution thereof by the said Charles Gregory is proved by the oath of Joseph Mumford & William Jarman, the subscribing witnesses thereto. It is therefore considered by the court, that the paper writing and every part thereof is the last will and testament of the said Charles Gregory and the same is ordered to be filed and recorded as such.
