This file was contributed for use in the USGenWeb Archives by: Beverly Cole ==================================================================== LOTT HUMPHREY WILL State of North Carolina County of Onslow Will Book 2 I, Lott Humphrey, do hereby will bequeath give and dispose my estate in manner form following. 1st I give unto my wife Ann or Nancy four Negroes, Jane & Harriet (men) Dick a woman & yellow (Harriet?) young woman, two beds & furniture, one clothes trunk, two large chests, three arm chairs & six winsom chairs, one pair candlesticks, one pair of cast fire irons, one pair shovel & tongs second qual., smo(o)thing irons, coffee mill, all of the crockery & pewter ware, knives & forks, half doz silver spoons marked LAH, one breakfast & one dining table & all the kitchen furniture, one bay horse, one grey crop card horse, one double stick (gigg?) & harness, one yoke of oxen & cart, four cows & calves, one hundred dollars in money & provisions for one year to her & her heirs forever. I lend unto her during widowhood the whole plantation and lands I bought from her brother Lott Ballard, also the lands I pattented joining or near thereunto the plantation & after her marriage only one half of the same during her life. I further lend to her negro woman named Kitty & children and man Amos for the term of five years, provided my daughter Olive lives five years to which child said land, Negroes is hereafter willed & given & provided further that said Negroes, land are & shall not be removed out of the neighbourhood & treated well & said Olive & Negroes and increase be kept free of charges. 2nd I give will or bequeath unto my daughter Thersa Hatch twenty dollars to her and assigns. 3rd I will bequeath unto my daughter Elda S., subject to the performance and payment of one hundred dollars to the direction of the subsequent part of this will, one bed & furniture, one clothes trunk, one side saddle & bridle, half doz silver tea spoons & half doz silver tablespoons, one hundred dollars in cash and all other of her Negroes as before conveyed by deed of gift to her & heirs forever. 4th I will and bequeath unto my son Lott S. subject to the performance and payment of one hundred dollars to the direction of the subsequent part of this will, my gold watch & (pendings?), all my library of books, the amt of the sale of cotton machine & fifty dollars in money and also repeat the gift and giving unto him my (illegible), or manor plantation (brick house) including all my lands that lies within and between Jenkins Swamp or branch & the N. W. branch of New River, also one mulattoe boy Levy as before unto him conveyed by deed of gift made January 1820, also give unto him one hundred acres of timbered pine land or the east side of Jenkins Swamp to be laid off an the north side nearest the public road out of the lands I bought of Hargett & Combs. 5th I will and give unto my daughters Minerva & Susan each subject to the performance and payment of one hundred dollars each as directed in the subsequent part of this will all the remaining part of the lands I bought of Hargett & Combs & Jesse Barrow & fifty acres I pattented adjoining the same, also repeat the gift & give unto them the following Negroes Isaac, Peter, Little Amos, Suzy, Penny, Eloah, (Black Havell?) & her child Lucy & Nancy (woman), Sam, (Leandru?), Ivy, Killis, Alfred, Louisa, & Rachel children as conveyed unto them by deed of gift made January 1820. Also fifty dollars in cash to each. 6th Then I will & Give unto my daughter Olive all and the whole of the lands that I bought of Lott Ballard Jnr. as will appear by his bond for a title yet to be made, also the lands I bound by patent adjoining the principle plantation or near the same I bought of Lott Ballard Jnr., also give unto her the following Negroes, Kitty a woman, her children Anthony, Casia, Hardy & George children & Amos & Bryan Men, also I give unto Olive the balance of amt of all the reaming part of my estate when and after all the appropriations by the direction of this will is complyed with, the whole of said property subject to the performance and payment of one hundred dollars by said Olive, the direction of the subsequent part of this will to her heirs or assigns forever. I desire that my Executors whenever opportunity may offer to buy as much as three hundred acres of pine timbered land at a price according to quantity and convenience for the benefit of my daughter Olive and her plantation. I desire that my Executors purchase a small undivided dividend of land lying in the lands I bought from Hargett & Combs at a price according to quantity and convenience for the benefit of Minerva & Susan. I will that my Executors apply one hundred dollars to the schooling & benefit of Julian Littleton. I now will and direct my five children as herein before reserved & provided at the arrival of the said Julian to the age of eighteen years that the first four named children buy and deliver over unto her one hundred dollars each as her legacy, herein by me provided and willed & that Olive at her own arrival at twenty one years of age, pay and deliver over to said Julian one hundred dollars as part of her legacy as before provided as above mentioned. I desire my executors to have the big house removed out to the place designed & refitted up with the chimney so far as to enclose the same in The Hall, Olive's plantation out of any monies belonging to my estate. I will two tracts of land that I bought of Lott Ballard Senr to be sold, about thirty or forty acres on the west side of the main road intersecting the lands of Charles Moore decd., and near the fork of the Court House Road, one other tract of land lying between the Court House Wilmington Road & Gravelly Run. I will all my undisposed of property to be sold and together with lands in hand of which pay my debts and comply with further requested of this will, then the balance to go to daughter Olive. I appoint Bro. Williams Humphrey & James Glenn and Daniel Ambrose Esqr Executors to this my true and last will; also the proper guardians of my children's estates, but to comply with the law as other guardians, In testimony whereof I have hereunto set my hand and affixed my seal October 6th 1823. (signed) Lott Humphrey Acknowledged before Jesse Ballard Moses Jarman Onslow County, in court February Term 1824 This will of Lott Humphrey was proved before the court by the oath of Jesse Ballard, one of the subscribing witnesses thereto & Williams Humphrey qualified as executor thereto. At the same term, the widow comes into court and entered her dissent to said will. Test: Banister Lester, clerk Widow dissents at the same time this will was proved State of North Carolina} Onslow County} Court of Pleas & Quarter Sessions, November Term 1840. It is ordered by the court that the last will and testament of Lott Humphrey decd, admitted to probate at the February Session of 1824 of the court be recorded (illegible) (per?) them.
