This file was contributed for use in the USGenWeb Archives by: Beverly Cole ==================================================================== SALLY HUMPHREY WILL State of North Carolina County of Onslow Will Book 2 I, Sally Humphrey, of the County of Onslow and State of North Carolina, being of sound mind and memory, but considering the uncertainty of my earthly existence, do make and declare this my last will and testament in manner and form following, that is to say: First, that my executor (hereinafter named) shall provide for my body a decent burial, suitable to the wishes of my relations and friends, and pay all funeral expences, together with my just debts, howsoever and to whomsoever owing, out of the monies that may first come into his hands as a part or parcel of my estate. ITEM I give and devise unto my beloved son John Humphrey all this tract of land whereon I now live to have and to hold to him and his heirs in fee simple forever, subject, however, to the performance and payment of forty dollars to my beloved son Lewis Humphrey as herein after directed. I further give and bequeath unto my son John Humphrey, my old mare, and bed bedstead & furniture, one cow and earling and all of my household and kitchen furniture, except such as are herein after particularized and bequested to my other children, all of my farming utensils, all of my hogs and all of my corn and fodder, bacon and provisions of every description and three sheep. ITEM I give and bequeath unto my beloved son Lewis Humphrey forty dollars in money, to be paid by my son John Humphrey as aforesaid out of the land given and devised to him. I further give and bequeath unto my son Lewis, one filly, two sheep, one cow and earling, one large clothes chest, one bed, bedstead & furniture. ITEM I give and bequeath unto my daughter, Sally Jarman, one big spinning wheel and one clock reel. ITEM I give and bequeath unto my beloved son Seth Humphrey one cow and earling, one bed, bedstead & furniture. ITEM and whereas my youngest son Lewis is a minor and not of the age of twenty one, therefore my will and desire is that my son Stephen Humphrey is hereby constituted and appointed his guardian to have and hold the custody and guardianship, both of his person and estate, untill he shall arrive at the age of twenty one years. And lastly, I do hereby constitute and appoint my beloved son Stephen Humphrey, my lawful executor to all intents and purposes to execute this my last will and testament, according to the true intent and meaning of the same, and every part and clause thereof, hereby revoking and declaring utterly void all other wills & testaments by me heretofore made. In witness whereof, I the said Sally Humphrey do hereunto set my hand and seal this 12th day of March AD 1844. Wallace & B. S. Koonce, Esq., the subscribing witnesses thereto and Stephen Humphrey Esq., the Executor therein named, appeared in open court and was duly qualified as executor aforesaid, when it was ordered that letters testamintary be granted to said executor and this will recorded as the last will and testament of Sally Humphrey.
