This file was contributed for use in the USGenWeb Archives by: Beverly Cole ==================================================================== WILLIAM MILLS WILL State of North Carolina County of Onslow Will Book 2 I, William Mills, of the county of Onslow and State of North Carolina, being of sound mind and memory but considering the uncertainty of my earthly existence, do make and declare this my last will and testament in manner and form following, that is to say: First, that my Executors hereinafter named shall provide for my body a decent burial, suitable to the wishes of my relations and friends; and pay all funeral expenses together with my just debts, howsoever and whomsoever owing out of the money that my first come into their hands as a part of my estate. ITEM first I give and devise to my beloved son William Mills, Jr., all this tract of land whereon I now live, bounded as follows viz., on the east by the N. W. branch of New River on the north by the land of Amos Askew, on the west by the land of Owen B. Cox & Lott Mills, and on the south by Baliways branch, up to the head of said branch, then a straight line, a west course to Dunnahoe branch, then up Dunnahoe branch to Lott Mills' line, to have and to hold, to him and heirs in fee simple forever. ITEM second I give and devise to my beloved daughter Lincy Mills, all that tract of land whereon Ainy D. Alphin now lives, bounded as follows, viz., on the east by the North branch of New River, on the South by the lands of John Jones, on the west by the land of Lott Mills, and on the North by Balaways branch, and the land devised to William Mills Jr., in the first item of this, my will, to have and to hold, to her and her heirs in fee simple forever. ITEM third I give and bequeath to my beloved son, Uzzah Mills, my Negro man named Lott, to have and to hold, to him and his heirs absolutely forever. ITEM fourth I give and bequeath to my daughter Eliza Ann, wife of Lewis Turner, (now residing in the State of Illinois), the sum of two dollars to be paid by my executors within two years from the time of my death, out of any money belonging to my estate, not otherwise disposed of, to her and her personal representatives forever. ITEM fifth I give and bequeath to my grandson Bryan Mills, (son of my son Bryan Mills, Decd.), the sum of two dollars as his right and property forever, to be paid by my Executors in the same manner as the last bequest, to him and his personal representative, absolutely forever. ITEM sixth My will and desire is that all the residue of my estate, if any, after taking out the devises & legacies above mentioned, shall be sold and the debts owing to me collected, and if these should be any surplus over and above the payment of debts, expences and legacies, that such surplus shall be divided in the following manner, that is to say; one half to my son William Mills Jr., and the other half equally divided between my son Uzzah Mills and my daughter Lincy Mills, in equal proportions, share and share alike, to them and each and every (one) of them, their heirs, executors, administrators, and assigns absolutely forever. And lastly, I do hereby constitute and appoint my two sons William Mills, Jr., & Uzzah Mills, my lawful executors to all interest and purposes, to execute this my last will and testament according to the true intent and meaning of the same, and every part and clause thereof, hereby revoking and declaring utterly void all other wills and testaments by me heretofore made. Koonce James Mills State of North Carolina} County of Onslow} Court of Pleas & Quarter Sessions, February Term 1845 The foregoing paper writing was exhibited in open court as the last will and testament of William Mills, decd., and the due execution thereof having been duly proved by the oath f James Mills, one of the subscribing witnesses thereto, it is considered by the court that said paper writing is the last will and testament of William Mills and the same is admitted to probate as such. Whereupon it is ordered by the court that the same be filed and recorded as and for the last will and testament of William Mills, deceased, at the same time Uzza Mills and William Mills, the two executors named in said will, came into court and were duly qualified as such.
