This file was contributed for use in the USGenWeb Archives by: Beverly Cole ==================================================================== FRANCES MONTFORT WILL State of North Carolina County of Onslow Will Book 2 In the name of God, Amen, I, Frances Montfort, of Onslow County and State of North Carolina, being of sound and perfect mind and memory, (blessed be God), do this 24th day of April in the year of our Lord, one thousand eight hundred and fifty, make and publish this, my last will and testament, in manner and form following, that is to say. First, I lend to my great niece Mary Elizabeth Hurst, wife of Charles Hurst, Negro woman Maria and her daughters Adah and Sidney, and negro girl Phebe and all their increase during her (Mary E. Hurst) natural life, and then to be divided between her children, and if one of them dies under age, its part to go to the other brothers and sisters forever. Secondly, I also lend to my niece Mary E. Hurst, wife of Charles Hurst, my horses and Barouh (?) and harness to her speceil use during her life. Thirdley, I lend to Francis Virginia Hurst, daughter of Mary E. Hurst, negro girl Easter, daughter of Sidney, during her life, and then to her children, and in the event of her dying without issue, then to go to her brothers and sisters. Fourthly, I lend to my sister in law, Mary French, if she should be the longest liver, Negro girl Elon, daughter of Daphine, during her life, then to return to my son Edward. It is also my will and desire that my said sister in law, Mary French, shall occupy and possess my house, and injoy a support off of the land on which I now live, during her life. Fifthly, it is my will and desire that my niece, Elizabeth Ann Spearman, shall occupy and possess the house where she now lives and land ajoining sufficient for potatoe patch and garden and have a support out of the proceeds of my property during her present widowhood. It is also my will and desire that my nephew David Sanders be supported out of my property. Sixthly, it is my will and desire that my son Edward W. Montfort give to William M. Fonville, son of Brice Fonville, decd., one of my negro boys or girls (as he the said E. W. Montfort may think proper) provided he the said William lives to be of the age of twenty one years, he then to injoy said negro forever, and increase. Seventhly, it is also my will and desire that all the residue of my real and personal estate not disposed of descend to my beloved son Edward W. Montfort, during his life and then to his children, and in the event of him, the said Edward, dying before his beloved wife, it is my desire that the said Louisa Montfort, wife of Edward W. Montfort, retain and possess all my real estate during her life and then to descend to Edward W. Montfort's children. Eighthly, I give and bequeath to Edward W. Ward, son of Eli Ward, Negro boy Matt, to his proper use forever. I herein constitute and appoint my beloved son Edward W. Montfort, my sole executor to this my last will and testament. In witness whereof I, the said Frances Montfort, set my hand and seal the day and year above written. Parker, one of the subscribing witnesses hereto and ordered to be recorded and filed as the last will and testament of Fanny Montfort, deceased aforesaid, when Edward W.
