I, William Philips, of the County of Onslow & State of North Carolina, being weak in body but in my perfect mind and memory & calling to mind that it be appointed for all men once to die, do make and ordain this my last will and testament in manner & form as follows, viz. It is my desire that all my just debts be paid by executors, burial expenses also. ITEM I lend unto my beloved wife Penelope Philips one negro man named Bob also one negro woman named Jinny, also one black horse, two cows & yearlings first choice, two sows & pigs first choice, ten head of sheep, all my household furniture except two feather beds & furniture, also the house where I now live and all the cleared land where I now live with the priviledge of timber to keep up the same during her natural life. ITEM I give to my beloved wife one Negro girl named Julia Ann to her & her heirs forever. ITEM It is my will and desire that at my death all the remaining part of my property not heretofore given away be sold and the profits equally divided between my wife and children and at the death of my beloved wife, Penelope Philips, it is my will that all the property lent to her during her life be sold and equally divided between my children. I now nominate and appoint my son in law Gardner Shepard to be my executor to this my last will and testament. In witness whereof, I have hereunto set my hand & fix my seal this 9th day of March 1840. (signed) Wm.
