I, Southy Waters, Sr., being of sound mind and disposing memory and calling to mind the certainty of death do make this my last will and testament in manner and form following. First, I leave unto my beloved wife one feather bed and furniture during her natural life or widowhood. 2ndly, I wish all my property consisting of land, cattle, hogs, sheep, horses, household & kitchen furniture and all other property, whether personal, perishable or real estate that I may own or possess at the time of my death, to be equally divided amongst my four sons, Southy Warters, Jr., Seth Warters, Harris Warters, & Haskel Warters, and my wife the part or portion that may be allotted to my said wife, I loan to her during her natural life or widowhood. Thirdly, the part or portion that I have loaned to my wife during her life, at her death, I give to my four sons, Southy, Seth, Harris & Haskell Warters. Fourthly, I appoint my son Southy Warters my sole executor to this my last will and testament and hereby revoking all other wills by me made and making this my only will. In testimony whereof, I have hereunto set my hand & seal the 25th day of November AD 1845. Signed sealed & delivered in presence of After the above was written which is my last will and testament so far as written, I further give to my grand daughter Polly Ann Reece, daughter of my daughter Aliff, one feather bed and furniture, but if she should die before she comes to age or marries, then I wish it to go to her (word omitted?) I loan to my sister Ann Eubanks, wife of Ezekiel Eubanks, one cow & calf or ten dollars in cash during her natural life and at her death, then I wish this legacy to go to my four sons, Southy, Seth, Harris & Haskell Warters.
