This file was contributed for use in the USGenWeb Archives by: Beverly Cole ==================================================================== JOHN WHITEHURST WILL State of North Carolina County of Onslow Will Book 2 State of North Carolina, Onslow County, In the name of God, Amen; I, John Whitehurst of the co. and state above named, being in perfect health mind and memory blessed be God for the same and calling to mind that all men have to die and feeling desirous of disposing of what it hath been pleased God to bestow on me of this world's wealth, it is my will and desire to bestow it in the following manner and form, viz., first I give to my daughter Sarah Ann Hardison one third of my two plantations, one where I now live and the place I now own on the north east side of Turkey Creek with one third of all my negro property, then I give to my son John T. Whitehurst one third of my two plantations one where I now live and the place I now own on the north east side of Turkey Creek with one third of all my negro property, then I give to my three grandchildren Rebecca, Leonidas, and Bryant (abbreviation illegible?) one third of my two plantations one where I now live and the place I now own on the north east side of Turkey Creek with one third of all my negro property to be equally divided between them when the youngest arives at twenty one years of age and should all my said grandchildren die, leaving no children, then it is my will that my two children Sarah Ann and John should have their part equally and I hereby nominate and appoint my son John T. Whitehurst to kepe in his possession and at his controle all the above named land and Negroes belonging to the said heirs and all the balance of my unmentioned property to be sold by my executor at a six months credit and all my just debts and expenses of all kinds to be paid and the balance to be equally divided among my heirs in the manner and form before mentioned and I hereby nominate and appoint my son John T. Whitehurst executor to this my last will and testament and I do hereby establish this to be my last will and testament. Horn State of North Carolina} Onslow County} Court of Pleas and Quarter Sessions December Term 1860 A paper writing purporting to be the last will and testament of John Whitehurst, deceased, is exhibitted for probate in open court by John T. Whitehurst the executor therein named and the due execution thereof by the said John Whitehurst is proved by the oath and examination of Joseph Ennett, one of the subscribing witnesses thereto and it is proved by the oath and examination of Owen W. Horn that he is well acquainted with the handwriting of the said James M. Horn, having often seen him write and that the name of the said James M. Horn subscribed as a witness to said will is in the handwriting of the said James M. Horn. It is therefore considered by the court that the said paper writing and every part of it is the last will and testament of the said John Whitehurst and the same is ordered to be recorded and filed. Whereupon the executor therein named appeared in open court and was duly qualified according to law = where letters testamentary were ordered to give to him.
