I, Brice Bender, of the County of Onslow and State of North Carolina, being of sound and perfect mind and memory (blessed be God) do this fifth day of November in the year of our Lord one thousand eight hundred and fifteen make and publish this my last will and testament in manner following, that is to say: I give and bequeath my soul to Almighty God who gave it and my body to be decently buried at the descretion of my executors hereafter named and my funeral expenses to be paid out of my estate first. My will further is that all my just debts be paid out of my estate hereafter named for that purpose, that is to say, I wish all my debts collected and my piny land on Waters Creek containing four hundred acres and my two houses and lots with their improvements and my store house and stables and part of a lot that they stand upon all situated in the town of Swansborough and all the navel stores that I now have on hand, a horse, two charer and harness and the stack of goods now on hand, to be sold by my executors and the money arising from the sale to be collected with the money that is now due me to pay the demands that I now have on hand purchased of Lent and Co. I wish returned provided they will take them as they were invoiced to me in payment for them and if not for them to be sold as directed above with the other property and the balance that may be remaining after all my debts be paid, to be disposed of as follows, that is to say: I give and bequeath to my beloved wife Alice one half of my land being in Carteret County that I bought of Allen Backhouse, containing by estimation seventeen hundred and some odd acres as will more fully appear by the deeds I now hold. The land by or referenced to the courses of that deed, during her natural life and the other half I give to the child my wife is now pregnant with when it comes to age or marries and should it die before it comes to age or marries, the hole of the land I give and bequeath to my beloved wife, to her, her heirs and assigns forever and at the decease of my wife, the half of the land I give her life estate in, I give and bequeath to my child should it then be living, to its heirs and assigns forever. And lastly, I give and bequeath to be equally devided between my wife and the child that she now is pregnant with the following property: three Negro men by the names of Charles, Louis, and Cesar; two Negro women by the names of Chana and Silva, and a boy by the name of Cesar and five girls by the names of Betta, Delila, Linala, Heriott and Mara and all of my household and kitchen furniture including all my estate, both real and personal. Should the child die before it comes to age or marries, my wife to have the hole of the Negroes and furniture as above in the lands to her, her heirs and assigns forever. As to the other balance of the money arising from the sales of the property left to be sold to pay my debts, to be equally devided as above between my wife and the child she is now pregnant with and in case the child should die before it arrives to the age above written, then its part both real and personal to go to my wife, her heirs and assigns forever. I hereby make and ordain my worthy friend Daniel M. Dulany my executor to this my last will and testament in witness whereof I, the said Brice Bender, have to this my last will and testament set my hand and seal the day and the year above written in the presence of us.
