This file was contributed for use in the North Carolina USGenWeb Archives by: Beverly Cole ============================================================================ Record of Wills, Book A 1800-1825 Onslow County, North Carolina I, Hezekiah Jones (Sr.) of Onslow County and State of North Carolina, seriously considering the uncertainty of human life at best, more particularly of my own in my present advanced stage, do while in a firm state of mind and sound memory, make this my last will and testament, intending hereby to dispose of my worldly affairs, not as humor may prompt but as justice and equity shall seem to direct. First of all: I most humbly recommend my soul to the extensive mercy of that all wise supreme intelligent being who gave it to me, most earnestly at the same time deprecating his justice. ITEM: 1st, my will and desire is that all my just debts be paid and satisfied by my executors. ITEM: 2nd, I give and bequeath unto my oldest son Carteret Jones one dollar. ITEM: 3rd, I give, devise and bequeath unto my second son Christopher Jones one dollar. ITEM: 4th, I give and bequeath unto my daughter Martha Barber one dollar, to them & their heirs forever. ITEM: 5th, I authorize my executors to sell to the best advantage and to convey the tract of land whereon Isaac Barber now lives, containing by estimation eighty five acres, and the proceeds thereof, after deducting necessary charges, to be equally divided among my three children already named, Carteret, Christopher, Martha Barber, heirs & assigns forever. ITEM: 6th, My will and desire is that my executors be supreme arbiters in all controversies that may arise and happen among my heirs and legatees and that their decision shall be final or conclusive without recourse to any other person or persons, or any court of jurisdiction whatsoever. ITEM: 7th, I lend unto my wife Mary Jones and my youngest son Hezekiah Jones (Jr.), during their natural lives, jointly & severally, to share and share alike the land whereon I now live which I purchased of James Smith containing by estimation 135 acres, also, all my stock of any kind, such as horses, cattle, hogs, furniture, farming utensils of every kind and description, under the care and superintendence of my executors as trustees for their use and benefit, only during their natural lives, and after the decease of both, said property to descend and be equally divided among the heirs of said Hezekiah, lawfully begotten in wedlock forever. But in failure of such heirs (after the decease of both), the same to be sold by my executors and, after deducting necessary charges, the proceeds thereof to be equally divided among my other children, them, their heirs and assigns forever. Last of all, I hereby nominate and appoint my friends William Hellen and Robert Dickson executors of this my last will and testament, giving and granting unto them full and discretionary powers, also revoking all others by me made, acknowledging this only. In witness whereof I have set my hand and seal, the 22nd September 1809.
