ONSLOW COUNTY, NC - WILL BOOK A - Rigdon Pitts, 8 Sep 1825 --------------¤¤¤¤¤¤-------------- Record of Wills, Book A 1800-1825 Onslow County, North Carolina In the name of God, Amen: I Rigdon Pitts of the County of Onslow and State of North Carolina, considering the uncertainty of human life do therefore while in a firm state of mind and sound recollection make and ordain this instrument to be my will and testament. IMPRIMIS: It is my wish and desire that my just debts be paid and satisfied by my executors. ITEM: I give and bequeath to my oldest son Hardy Pitts Negroes Lot and Bob Sr., purchased from the estate of John Hay, heirs and assigns. ITEM: I devise to my grandson Richard Pitts son of Hardy my goose pond lands upon the following terms, say to his entire use and behoof during hisnatural life & after to such lawful issue as he might have living if none such at his demise then and thereafter to decend to his father Hardy Pitts heirs and assigns but upon the aforesaid terms I devise to said grandson Richard one Negro boy Henry and in case of demise without living open to desend to his father Hardy Pitts heirs and assigns. ITEM: I devise to my youngest son Richard Pitts the following lands in the county and state aforesaid upon the following terms that is to say to his entire use and behoof only during the term of his natural life & after to such issue as he may have living say support of my land and tenement on Pitts Creek within the lines of boundaries from near the mouth of Pitts Creek on to a ditch I cut in front of my dwelling onward the whole course of said ditch to the river including the marsh land thereto adjoining thence to the beginning including the building there on but in default of any such issue at the time exausted at his demise to descend to my four daughters Rhoda, Peoebe Banitr & Elizabeth as joint tenants heirs & assigns forever. ITEM: The residue of my lands on Hobbs Creek alias Ash Creek I devise upon the following terms to my grandso Rigdon Pitts here it say unto him during life and to such legal issue as he may have at his decease by in default of any such living at his demise to decend to the surviving children of my daughter Nancy her it theirs and assings. ITEM: I devise to my son Richard Pitts the following Negroes to wit Peter his wife Rhoda and boy Dave their heris and assigns. Also Negro boy Sutton heirs and assigns. ITEM: I give and devise to my daughter Nancy hearit Negro Hannah & Rosa and their increase her heirs and assigns. ITEM: The residue of my Negro slaves I devise to my four daughters to be set of in equal division so that they share equally alike and daughters names are Rhoda, Phoebe, Beniter and Elizabeth their heirs and assigns and further to said daughters that they are or my executors select from my beds and furniture that they fairly ballot for the same as that they are heirs and assigns. ITEM: The residue of my estate real and personal not already devised to be sold by my representive on a credit of six months proceeds of sale case in hand, book debts after the liquadition of such just claims or may stand against me unpaid, to descend and be equally divided between my four daughters Rhoda, Phoebe, Beniter and Elizabeth , heirs and assigns. Finally I constitute my friends William P. Ferrand, Hardy Pitts, and Abram Mitchell executors to this will revoking and renouncing all others. In testimony I the said Rigdon Pitts have to this instrument set my hand and affixed this to my seal the eight day of September One thousand eight hundred & twenty five (1825). Dickson ONSLOW COUNTY: In court November term 1825, this will of Rigdon Pitts was duly proved in open court by the oath of Elen Burnap Rhoda Newbolds and Robert Dickson the subscribing witness thereto, and Abram Mitchell and Hardy Pitts two the executors therein named qualified thereto by taking the usual oath and executor.
