ONSLOW COUNTY, NC - WILL BOOK A - Gains Rowe, 29 Nov 1812 --------------¤¤¤¤¤¤-------------- Record of Wills, Book A 1800-1825 Onslow County, North Carolina In the name of God, Amen: I Gains Rowe of the County of Onslow and State of North Carolina, being indisposed of body but of sound and disposing mind and memory and calling to mind the uncertainity of life have thaught proper to make constitute and ordain this my last will and testament. First and principally I recommend my soul to Almighty God who gave it and my body to the dust from whench it came to be buried in a plain decent Christian like manner touching the worldly things it has pleased God to bless me with I dispose of in the following manner, VIZ: FIRST: I give and bequeath to Mary C. Snead one Negro boy named John, one black colt named Boll, one bed and furniture and all the cattle that are in her mark. 2ND: I give to my wife Harriet M. Rowe the following Negroes VIZ: Darby, Jack, Lucy, Silvy, Killis, Virgil, Hester and Maranda to her and her heirs forever. I also give to my said wife all my personal property of every discription whatever exceting the Negroes hereafter bequeathed with this ristriction that she shall pay all my lawful and just debts and purchase for my son James a Negro girl of the ago of twelve or fourteen years within two years after my deceased, and not to charge to the estate of my said son anything for his expenses and the maintenance of Negro woman and children hereafter bequeathed to him for the term of one year after my death I also lend to my said wife all the land on the east and south side of Couhorn road except the piece of cleared land adjoining W. Mills during her natural life with the privilage of tending one half yearly in corn and as much of the other half as she may think proper to sow herself in small grain also grant to my said wife the privilage of clearing the piece of land between Couhorn road and the long field square with said field I also lend to my said wife one Negro girl named Grace for the term of seven years from and after my deceased. 3RD: I give and bequeath to my son James G. Rowe the residue of lands including that lent to my wife after her death together with the following Negroes VIZ: Tyron, Lou, Abel, Flora, Tener, Grace, Maria, Julia, Warrick, and Sam, to him and his heirs forever with the exception of the negro girl Grace for the term of years she is lent to my wife. 4TH: In case of my said son James dying before he arrives to the age of twenty one or having lawful heirs begotten of his body, I then give and bequeath to Ann Shackford thepiece of cleared land adjoining W. Mills and at my wife death all the lands lying on the east side and south side of Cowhorn road together with one Negro man named Lon to her and her heirs forever to Richard Shackford I give and bequeath the residue of the land I bought of Hannah Iredel, Treadwil and others together with one Negro man named Tyrone, to him and his heirs forever. To Mary C. Snead all the lands bought of the Mumfords, Jones, etc., together with one Negro man named Abel to her and her heirs forever. To Elizabeth Morgan one half of the Negroes I got by my intermarriage with Catharine Gillespie together with one half of their increase. The other half of said Negores and their increase I give to the children of Jane Wright, Lucy and Mildred Gillespie Dickson, that is to say one fourth to the children of Jane Wright the other fourth to the children of Lucy and Mildred Dickson to be equally divide among them to Elizabeth Mitchell I give one set of tables and teaspoons. To Catharine Jane Gillespie the negroe girl that I have ordered to be purchased out of my personal estate for my son James together with his increase to her and her heirs forever. 5TH: I hereby empower my executrix hereafter named to convey by deed to the executor or heirs of Josiah Cox a few acres of land adjoining Jenkins Branch providing the executor of said Cox will convey to my heirs or executrix the same quantity agreeable to a line established by said Cox and myself. 6TH: It is my will and desire that the lands bequeathed to my son James should be rented so as but one half to be cultivated yearly with no privilege on the other half binding the rentors to continue the fence where they stand and to keep them in good repair. 7TH: I hereby nominate and appoint my wife Harriett M. Rowe whole and sole executrix to this my last will and testament and I also appoint my said wife guardian to my son James without requiring her to inter into any bond for her guardianship, but with this injunction that she make due report to the county court of her proceedings. It is my desire that my said son to be under the direction and government of my friend B. C. Gillespie and in event of my wife's death, I nominate the said B. C. Gillespie guardian of my said son with the privilege and under the same injunction as directed respecting the guardianship of my wife and in case of my wife death and in the death of my son, I then nominate and appoint B. C. Gillespie, Richard Shackelford, James Gleen and Abner Harget executors to carry into effect this my last will and testament, hereby revoking all other wills or will by me heretofore made. In witness whereof I have hereunto set my hand and seal this 29th day of November in the year of our Lord 1812. Gains Rowe (seal) The words between the twenty-third and twenty-fourth lines on the first page excepting the Negroes hereafter bequeathed and the words between the fifth sixth lines on the last page, and the death of my son all being interlined before signing. Signed sealed and pronounced in the presents of: Edmun Wright Elisabeth Basden Lott Ballard CODICIL: It is my will that my executrix should think proper in order to keep Abel and his wife together may be at liberty to exchange him at any time for another fellow of equal value with the owner of his wife. And I wish it to be understood that if my son should die in nonage that the above named Negro Abel be and remain the property of my wife during her life and then I give said Negro to Mary C. Snead, Nov. 29th 1812.
