ORANGE COUNTY, NC - DEEDS - William Courtney to James Christmas 19 Feb 1797 Orange County Deed Book 7 page 8 William Courtney to James Christmas This Indenture made this 19th day of February in the year of our Lord one thousand seven hundred and ninety-seven. Between William Courtney of the town of Hillsborough, county of Orange and state of North Carolina of the one part and James Christmas of the county and state aforesaid of the other part. Witnesseth that for and in consideration of the sum of five shillings to be paid by the said James to the said William on the first day of April in this and every year hereafter during the term of the said William's natural life the said William does lease to the said James a tract of land on the waters of Ero in the county aforesaid adjoining the lands of Edward Turner, John Caragan, Thomas Crabtree, William Walters deceased, William Whitted, Thomas Watts and William Lockheart containing three hundred acres with all the privileges there unto belonging only with these restrictions the road leading from the town of Hillsborough passing through the said land to Bentons Mill the said James shall not be at liberty to cut sell or dispose of any timber on the north side of the said road but shall be at liberty to make use of any he the said James shall think necessary for fire wood for his own family. Poles for James building his own houses and shall be at liberty to clear on the north side of the said road as much land as he the said James shall himself want to cultivate but not lease employ land or lands to cultivate on the said north side of said road any land but on the south side of said road shall be at liberty to clear and land to cut timber for rails to fence two uncultivated fields and apply all profits to his the said James' own use and be at liberty to employ hands to work the said south side of the said road in number not to exceed ten and if the said James shall rent my part of the said land he shall appropriate all the benefits to his and his families use and further on the south side of said road the said James shall be at liberty to sell and dispose of any timber for firewood that the said James shall not think will make poles, shingles, planks, stances lumber … nevertheless the said William shall not be prohibited from the privileges of the said land witch he has theretofore enjoyed only with respect to the rents and if the said James should remove from the said land before the death of the said William the land shall become the said William's and his heirs as if this lease had never been signed by the said William and further if the said three hundred acres of land should by any debt hereafter contracted by the said William be sold to satisfy such debts the said James shall have no claim to it whatsoever by virtue of his this lease as witnessed my hand and seal the day and date above written.
