This file was contributed for use in the USGenWeb Archives by: Harriet A Odom HODOM@prodigy.net ==================================================================== Transcript of Transfer deed from Richard & Andrew HUNTER to Cuthbert BURTON Articles of Agreement, covenant, and release, made done and executed by & between Andrew HUNTER Of the county of Burke and Richard HUNTER of Lincoln of the one part and Cuthbert BURTON and Christian late Christian HUNTER his wife of Orange County and State of North Carolina of the other part (to wit) Whereas James HUNTER late of the county of Orange now deceased, in and by his last will and testament duly made and published on the 8th day of February 1794 and duly proven at February Term 1794 of said county devise as follows first I give and bequeath and devise unto my beloved wife Christian HUNTER, all that I possess of worldly goods to use at her discretion during her natural life. 2nd at my beloved wife Christian HUNTER S death, I give and bequeath to James Hunter Andrew, twenty pounds current money of North Carolina. 3rd I give and bequeath unto Richard HUNTER all the rest of my worldly Estate at my wife s death, but if he should die without issue, then to belong to my brother Andrew HUNTER & his heirs forever" And whereas since the death of the said James HUNTER, the said Christian in all the property and estate of the said James HUNTER deceased, and the parties hereto being minded and desirous to make a final and complete settlement of their interest in the property and estate of the said James HUNTER do covenant and agree as follows: the said Richard HUNTER and Andrew HUNTER being the same persons named in the will of the said James for a valuable consideration already paid to them by the said and by their presents doth grant bargain and sell to the said Cuthbert BURTON his heirs and assigns forever a certain tract or parcel of land lying in the county aforesaid Beginning at a post Oak then west thirty five chains to attack Oak then north forty-six and a quarter chains to a white Oak, then East thirty and a half chains to the East side line then with said line south to the beginning containing one hundred and seventeen and a half acres be the same more or less to have and to hold the said tract or parcel of land together with all the right priviledges and appurtenances thereunto belonging to him the said Cuthbert BURTON his heir and assigns forever and the said Stephen Carrell doth hereby oblige himself his heirs Executors and Administrators to warrant and forever defend the above mentioned premises to the said Cuthbert BURTON his heirs and assigns against the lawful claims of all persons whatsoever. In witness the said Stephen Carrell hath hereunto set his hand & seal the day and year above written.
