Ephraim Roberts to James Nutt

This Indenture made this fifth day of October in the year of Our Lord One 
thousand eight hundred and thirteen Between Ephraim Roberts of the County of 
Orange and State of N. Carolina of the one part and James Nutt of the County 
of Wake and State aforesaid of the other part Witnesseth that the said Ephraim 
Roberts for and in consideration of the sum of five hundred Dollars to him in 
hand paid by the said James Nutt the receipt whereof is hereby acknowledged 
hath given granted, bargained and Sold and by these presents doth give grant, 
bargain, sell, alien and confirm unto the said James Nutt a certain Piece or 
Parcel of Land situate lying and being in the County of Orange & on Ellibees 
Creek and bounded as followith Begining at a Spanish Oak & dogwood on the bank 
of Ellibes Creek thence North thirty degrees West twenty six and a half chains 
to a red Oak & white Oak then North thirteen and a half chains to a Post Oak 
then North Forty five degrees East twelve chs. to a white oak on the side of a 
branch then down the branch as it meanders to a white oak formerly Abner 
Veazeys corner thence South forty eight degrees East thirty six and a half chs 
to a maple on the Bank of Ellibes Creek then up the Creek to an Iron wood 
Corner then South fifty degrees West thirteen chs. to a white oak then up the 
Creek as it meanders to the first Station containing by Estimation One hundred 
and Sixty five Acres be the same more or less with the reversion and 
reversions, remainder and remainders, rents and Services, and also all the 
estate, right title Interest property claim and demand whatsoever of him the 
said Ephraim Roberts his heirs, To have and to hold to the said James Nutt his 
heirs and assigns forever and he the said Ephraim Roberts doth Covenant the 
aforesaid Land & Premises and every part thereof to the said James Nutt and 
against himself and his heirs and the claim or claims of all and every other 
person or persons whatsoever, shall and will warrent and forever defend by 
these presents In witness whereof the said Ephraim Roberts hath hereunto set 
his hand and affixed his Seal the day & year first above written –
